Consensual sex with minor not a crime, Delhi court says

NEW DELHI: A city court has observed that consensual sex with a girl aged below 18 years does not constitute an offence under the Protection of Children from Sexual Offences (POCSO) Act.

The court said the provisions of POCSO Act suggest that where a physical relationship — which is not in the nature of an assault — takes place with the minor girl's consent and where the consent has not been obtained unlawfully, no offence can be said to have been committed.

Rejecting the plea of the police and Delhi Commission for Women that POCSO Act prohibits minors from having any kind sexual relationship, additional sessions judge Dharmesh Sharma said, "I am afraid if that interpretation is allowed, it would mean that the human body of every individual under 18 years is the property of the state and no individual below 18 years can be allowed to have pleasures associated with one's body."

ASJ Sharma, however, urged state authorities to spread awareness related to unsafe sex or early marriage. "But there lies a greater responsibility on all of us, the state including police in spreading and creating public awareness about the impact of girl or boy marrying at a tender age or indulging in unsafe sexual activities," he said.

The court made these observations while acquitting a 22-year-old youth of charges of kidnapping and raping a 15-year-old girl whom he later married. The youth, a native of West Bengal, was acquitted of the charges as the court held that the minor, on her own will, accompanied him and obstacles should not be put in their happy married life.

"As the evidence indicates, they got married voluntarily with their free consent. Hence no case is made out under section 363 (kidnapping) and 366 (kidnapping or inducing woman to compel her marriage) of the IPC," the court said.

"In my opinion, it would neither serve the object of present enactment (POCSO Act) nor the purpose of criminal laws to hold the accused guilty on the ground that he had sexual intercourse with the girl below 18 years," the judge said, adding that it would not be good for the girl if her husband was sent to jail. The POCSO Act treats girls and boys below 18 years of age as minors.

"It is high time that state authorities, its machinery, NGOs and women groups made a determined and sustained endeavour to reach out to all in schools, colleges and residential places, thereby creating public awareness on various aspects of life in case of marriage at a tender age... besides creating awareness amongst adolescents and young adults about the serious psychological and physical health issues that such a relation entails," the court observed.

According to the prosecution, a complaint was filed before the police on March 5 by the minor girl's mother about her daughter going missing since February 26.

The accused was arrested on March 6 and the girl was also recovered from his custody, it said. The girl, in her statement recorded before a magistrate, said she had willingly gone with the accused to his native place in Kolkata and they got married in a temple there and since then they have been living together.

During the trial, the youth told the court that the girl had accompanied him to Kolkata on her own and they got married there but he denied having physical relations with her. The court also noted that the marriage was accepted by the girl's mother.

Rajya Sabha passes marriage laws amendment bill

New Delhi, Aug 26 (IANS) The Rajya Sabha Monday passed a bill to amend marriage laws which seeks to provide for irretrievable breakdown of marriage as a ground for divorce, subject to certain safeguards to the wife and affected children.
The Marriage Laws (Amendment) Bill, 2010 was passed by voice vote. It seeks to amend the Hindu Marriage Act 1955 and the Special Marriages Act, 1954.
Replying to the brief debate, Law Minister Kapil Sibal said there was need to protect women's rights as the society was still patriarchal.
"So let's be clear. Legislations are a message that MPs are on the side of women in a patriarchal society. With this intent we bring this bill," he said.
Speaking on the amendments, Sibal said the share of wife in husband's self-acquired property will be decided by court. He said the wife also has a share in the movable property of her husband.
He said the wife does not have share in inherited property but its value will be taken into account while fixing the amount of alimony to her.
He said either husband or wife can cite irretrievable breakdown of marriage as a ground of divorce.
There have been concerns that provisions of earlier marriage acts were inadequate in cases of irretrievable breakdown of marriage.

Supreme Court: Karunanidhi's wife need not come to Delhi court, can be questioned in Chennai

New DelhiThe Supreme Court has asked a court investigating the 2G spectrum scam to appoint a commission to question DMK leader M Karunanidhi's wife Dayalu Ammal at her home in Chennai, on medical grounds.

The court acted on a report submitted by the AIIMS hospital, after Dayalu Ammal's daughter petitioned that she was too unwell to step out of her home.

Dayalu Ammal has been summoned by a special CBI court as a witness in the telecom case linked to the allocation of valuable 2G spectrum to ineligible companies at throwaway prices.

Her daughter Selvi had sought an exemption and told the Supreme Court that Dayalu Ammal could not respond to the summons, she had been diagnosed with behavioral problems and was losing her ability to even recognize close relatives.

Dayalu Ammal, Karunanidhi's second wife, was a director in Kalaignar TV Private Limited, which allegedly received a bribe of over Rs. 200 crore from a firm that bagged licences for spectrum at dirt-cheap prices when DMK's A Raja was Telecom Minister.

Karunanidhi's daughter and DMK Rajya Sabha member Kanimozhi is also an accused in the case.

HC notice on Pascal’s plea for visitation rights to his mother to see his children

The Karnataka High Court on Tuesday ordered issue of notice to Suja Jones Mazurier on a petition filed by her husband Pascal Mazurier, Consular Attaché to the Consulate General of France, Bangalore, and accused in a case of raping his minor daughter.
Justice A.S. Bopanna passed the order on Mr. Pascal’s petition, in which he has challenged the Family Court’s order refusing to allow his mother, who had come from France, to periodically meet his three children, who are in the custody of his wife.
IN the petition he also said his wife had violated an order of the Family Court to bring the children to the Bangalore Mediation Centre between 3 p.m. and 4 p.m. on July 24 to for meeting his mother, and children’s grandmother, Jacqueline Maillé. The Family Court had only twice permitted Jacqueline Maillé to meet the children since February 2013 and that too only for an hour on each occasion.
“The Family Court ought to have permitted the petitioner’s [Pascal’s] mother to have constant periodical contact with her grandchildren so that some member of the petitioner’s family can be in touch with the children,” it has been contended in the petition.
In matters relating to the guardianship and custody of minor children, especially of those children who have multi-cultural and multi-national identities, the Family Court ought to bear in mind the various provisions of the United Nations Convention on the Rights of the Child (UNCRC) which came into force in September 1990 and to which India is a signatory, the petitioner claimed.
The petition further stated: “The children are completely cut off from their paternal relations and this is not in the interest of their emotional and psychological welfare and wellbeing as the petitioner was always close to the children during the time he lived in the marital home…” It has been alleged in the petition that his wife was depriving the children of contact with his family members.
Mr.Mazurier was arrested in June 2012 on the complaint filed by his wife, and the High Court in October 2012 had granted him bail while observing that “the materials on record, including the DNA report, and the statements of witnesses at this stage are in favour of the accused [Pascal]”.

Pictures of National Meet of Indian MHRAs

The Indian Men’s Rights Movement had a good start in 2004. (Note: See AVfM’s message of support and solidarity here–DE) We never wanted to centralize it into one organization. We made it mandatory for men’s rights activists in every city to start their own NGOs. As a result, today there are more than 40 men’s rights NGOs in India. In Bangalore itself, there are 7 men’s rights NGOs. The central theme of most of these men’s rights NGOs is the support group meetings, which almost always focus on supporting men going through marital problems, courts case or facing domestic violence. The value that a man often gets by attending these support group meetings is immense. He gets clarity, peace and learns laws, which actually cuts his lawyer fees in half. The fundamental principle of Indian Men’s Movement is, “No matter what happens to you or your life, enjoy life; enjoy every moment of it”.
Today, Indian MRAs are actually among some of the happiest people in India. The bad circumstances of life have no impact at all on them. That is what is reflected in the annual National Meets that Indian MRAs conduct every year.
This year, 114 MRAs from all corners of India converged at a resort at Pench National Park, to attend the Men’s Rights National Meet. This national park is actually a tiger reserve with at least two dozen Bengal tigers roaming in this forest. In the day time, they had hectic schedule of presentations and in the evenings they danced and partied together.
Most guys met each other for the first time, though they have known each other through social media. The presentations this year focused on a variety of topics from lobbying at parliament, future of the movement to topics like, how to manage your own fear. On the first day, MRAs from different cities shared their success stories. Most of them wore Men’s Rights T-Shirts.

पुरुषहो, तुमच्यासाठी...

Tamil Nadu tops country in cases of domestic violence

Tamil Nadu tops country in cases of domestic violence

CHENNAI: Disturbing statistics released by the National Crime Records Bureau (NCRB) show that domestic violence is much more prevalent in Tamil Nadu than any other state in the country.
The NCRB data shows the state registered 3,838 cases of domestic violence in 2012 — or 84% of all complaints (4,567) of domestic violence recorded across the country.

Tamil Nadu recorded the most cases of domestic violence in the country, 3,983, last year too, a finding cited by minister for women and child development Krishna Tirath on August 14.
Experts offer several reasons for the high numbers in the state. These include greater awareness about the law in Tamil Nadu and due to an increase in education among women. Police officers, however, say tolerance levels are plunging among young couples, and this has led to a spurt in complaints.
Most complainants are women from middle-class and upper middle-class families.
The Protection of Women from Domestic Violence Act was enacted by the Union government in 2005 to protect women from violence at home.

worried about law misuse

Activists make a case of 'Musculism'

'Society and laws need to be men-friendly too'

While all of us were celebrating Independence Day, a few men from all over the country assembled in the city to discuss some pressing issues. They were members of various men's rights organizations who had come to attend a national conference under the aegis of Men's Rights Association (MRA), a first-of-its-kind event. Two of the pioneers of the movement in India, IT professional and one of the founders of Save Indian Family Foundation, Pandurang Katti and, businessman and president of Children's Rights Initiative for Shared Parenting (CRISP), Kumar Jahgirdar spoke to TOI about the emergence of men's rights movement, the need for more gender-neutral marital laws and masculinity among other things.

Excerpts from an interview ---

What prompted you to consider being part of the men's rights movement?

PK. Small things like different tax slabs for same salary levels and reserved seats in public transport seemed unfair to me. Then came article 498A which I read was being misused in many cases. Then it hit closer home when I was acquitted under the same law in 2004. It was my wife's word against my evidence and our genders dictated the assumption of who was wrong.

What do you think of society's definitions of roles of men and women?

KJ. Sadly, the age-old mindset of men being providers and women being homemakers still prevails. Despite all talks about equality, society does not treat men and women equally. This extends to marriages as well, without realizing that marriages are not for competing but for complementing each other.

PK. Men are looked upon as monsters until they prove otherwise. There are several wrongful expectations from men which are seen in many aspects of life a" work, marriage and even in relations before marriage. The blame for any woman's committing suicide is invariably pegged on a man close to her, like it happened in the Suraj Panscholi case. There are cases like that Kausar Begum of Bangalore who married 12 times, earning lots of money by getting all the husbands arrested under domestic violence act.

How do you perceive women's rights movement?

KJ. It has become fashionable to talk about women empowerment and women's liberation in the name of chivalry. While doing so, human rights are sometimes kept on stake. Women have suffered a lot, for centuries. But thatas no excuse to make the current generation of men suffer, too. We must have a more human approach to things rather than feministic or chauvinistic.

Which Indian laws do you think are unfair?

PK. Several laws are misused by women, and used as a way of blackmailing men. Article 498A, that deals with dowry-related cases is the first that comes to mind. We believe it should be made a civil law, and a bailable offence. Under the Domestic Violence Act, the very definition of violence is questionable. Even domestic tiffs can land an entire family in jail. Rape laws are applicable to a man promising marriage to a woman if they have been intimate. This happens only in India.

KJ. The very reason we have shunned the celebrations of Independence is Marriage Law Amendment Bill 2010. Under this bill, it is proposed that a man can't challenge a divorce petition filed by his wife. It also allows the woman a claim over ancestral property of her former husband after divorce. This bill is unfair in so many ways. In cases of separation of parents, the judiciary in India assumes that the child needs a mother more than a father. A bad husband is not necessarily a bad father. All children need both parents equally.

Are there any suggestions for improving the current laws?

PK. In several divorce cases, the women ask for big amounts of alimony that are many times unjustifiable, like when a doctor wife asked her husband for a big sum monthly, of which Rs 35,000 was to be spent on entertainment. While deciding these amounts, especially in cases where the woman is gainfully employed, the financial and other situations of both parties must be duly considered.

KJ. To reduce the stress of a breaking marriage on children, shared parenting must be allowed as a norm. These cases must be disposed at the earliest possible. People found guilty of misusing laws like 498A, domestic violence act and such must be punished. Also, many times when women violate court orders judges go soft on them, which should not be done. Children's rights are constantly ignored in cases of separating and divorcing parents, where they are even used as weapons to fight personal battles.

You call the movement you have started "masculinism". How does it differ from chauvinism or chivalry?

PK. There is what we call cultural chauvinism in our society. This calls for more realistic expectations from men instead of putting excessive responsibility on them. The modern society gives women equal opportunities, so it is only fair to provide men with certain choices and freedom, too. Laws and society need not only be women-friendly but also men-friendly.

The changes in the way of living have affected marriages, too. Does that strike as a positive change to you?

KJ. In modern marriages, both men and women share all responsibilities, whether they are domestic or financial. This culture is spreading very fast, too. However, the cases of divorces and legal hassles that people have to live with for their whole lives are also increasing.

“I will fight against misuse of 498A”, affirms Prince Tuli in Nagpur; To sue ‘Zanjeer’ producers for using bike sans permission

It’s been a while since the ugly face of marriage between Prince Tuli and his estranged wife formerly crowned Miss India Yukta Mookhey came out in the open. The allegations and counter charges framed by Yukta against her beleaguered husband followed by severe jolts received on the part of the latter and his family only worsened the situation.  However all the allegations came from Yukta while Tuli chose to keep mum as the case progressed in the court of law. Even Tuli categorically denied giving any interview which quoted him as citing adultery behind the broken marriage. The interview was carried across media.
Nagpur Today got to interact with Prince Tuli to hear his side of story. In an exclusive chat with Nagpur Today, Prince Tuli opened up his heart regarding various unwanted and disappointing events taking place in his life! Prince also spoke at length about his Superbike, Kawasaki Ninja ZX 14 Limited Edition which has been featured in first song titled ‘Mumbai Ke Heroes’ from the film Zanjeer, without his permission.
The Excerpts…
Nagpur Today   : Is it true that you dint give any interview regarding the allegations of Yukta on you to Mumbai mirror?
Prince Tuli         : Yes! I definitely haven’t quoted anything in this context to any media till date. When I’m not allowed to do so by law, why would I do so and see myself behind bars? Plus I would never disrespect the mother of my child, and clean my dirty laundry in public.
Nagpur Today   : Were the statements mentioned in that interview true?
Prince Tuli         : I never quoted such statements. I am a stake holder at the Adai Mehra Production Pvt Ltd. I gave an interview regarding the remake of the movie ‘Zanjeer’ remake, and nothing related to what is published.
Nagpur Today   : How is your family doing?
Prince Tuli         : We are going through tough time. All my family has to come and report at Mumbai. My mother is a cancer patient. She is such an adorable and straight person who doesn’t at all deserve such a harsh treatment. Yet she has to travel twice a week to Mumbai and report at the police. The policemen harass her by asking uncomfortable and upsetting questions. Such harassment of an old lady is just inhumane.
Nagpur Today   : What shall be your future course of action in this context?
Prince Tuli         : Around fifty to sixty thousand people commit suicide every year just because of these fake, fictitious allegations and misuse of the 498 A law. It’s high time that this victimization of families and the stupid gender bias should be stopped. I’ll fight not just for myself, but every victim of the misuse of this law till I breathe my last.
Nagpur Today   : Yukta has openly come forward, even in front of media and put allegations on you. Why have you not come up with your side of explanations and proved your point straight in public?
Prince Tuli         : We are ‘Khaandani’. We shall never entertain or put forth anything undue and despicable for that matter. Whosoever needs cheap publicity can definitely grab it, we would never let our standards fall! We have never talked abrupt; in future as well we shall remain composed in spite of the cheap compellations.
Nagpur Today: It is learnt that your bike has been featured in the title track of Zanjeer the promos of which are out now. But you have some issues with the producers?
Prince Tuli : The co-producers of this film are Reliance Entertainment and Amit Mehra’s Flying Turtle Films. I shall even sue the producers, Reliance Big Entertainment Pvt. Ltd., if entire song is not omitted from the flick, because the bike has been used without my permission.
Apoorva Lakhia approached me to borrow my bike for a friendly ride, wherein I refused to part with my bike but on continuous persistence agreed to let Lakhia ride the bike.
The bike is extremely dear to me and i have an emotional connect with it. I had bought this bike in the year 2008 and had specially imported this bike from New York which at that time costed approximately Rs.35 lacs. I was shocked when I discovered the presence of bike in the song of movie directed by Lakhia and was extremely hurt that the bike which was taken on a friendly ride, without my consent was used for commercial purpose in the film. I have asked to immediately remove every scene featuring my bike failing which legal action would be initiated.

Official Amendment for Marriage Bill - Home breaker & anti men

It’s Freedom Friday for harassed husbands near Nagpur; “Independence Day” today!!

It’s Freedom Friday for harassed husbands near Nagpur; “Independence Day” today!!

Nagpur News.
It’s a male’s day altogether…or the Husband’s Independence Day to be more precise. While the people across the nation might have celebrated Independence Day on Thursday in solidarity with the traditional practice, a handful group of men acted otherwise. Feeling leftover in the series of issues pertaining to individual rights, husbands have moved a step forward in affirming their self in their own right and marked Friday as their day of ‘Independence’. The city of Nagpur would be a part of the one of its kind revolution which is running into its fifth year.
5th National Men’s Rights Conference 2013, an event jointly conducted by a group of organizations fighting for equal rights to men in Hindu marriages would be held Friday at
Pench Jungle Home Resort near Nagpur.
Arnab Ganguly, a member of one of the participating organization called INSAAF told Nagpur Today, “We have found Nagpur as our strong chapter. We have got strong support from over 3500 members here. It is centrally located and easier to reach. So this year we have chosen this venue for conducting our event.
He told Nagpur Today, “On Friday we will be conducting the conference while tomorrow we would be debating on marriage laws.”
He informed that last year we could not conduct the event as we had moved to Delhi to press for the amendments in Hindu Marriage Bill. “Our previous events were conducted in Shimla, Kolkata and Yercaud in Tamil Nadu. We are fighting for the men’s rights as the provisions of current Hindu marriage bill are extremely dangerous and essentially targeting men in Hindu marriages. It allows wives to acquire 50% of the ancestral property. Even when the Hindu man is not married, 50% is accorded to his wife although she has not contributed in the property. This is very dangerous act which affects Hindu families badly. It will push husbands to become criminals. We want the government to make amendments but it did not pay any heed. Even the proposal is awaiting to be tabled in Lok Sabha or Rajya Sabha. It would be put up by Monday or Tuesday,” he said.
Another organization Child Right Initiative for Shared Parenting (CRISP) working towards the equality of parenting rights among married men and women is participating in the movement to push the envelope further.
Kumar Jahangirdar, founder and president, CRISP said, “We did not participate in the celebrations Thursday to mark the country’s Independence Day. We, a group of men who are seeking parenting rights and joint custody of their child, are meeting in Nagpur on Friday to demand ‘freedom’ from women-centric laws.
Over 100 men from across the country would participate in today’s movement. CRISP, which has been fighting for the rights of fathers and children for more than five years, in partnership with Save Indian Family, has organised this annual event which would be conducted for fifth year in a row.
Among the issues slated for discussion during the summit are Marriage Laws Amendment Bill of 2010. “The law makers have an assumption that children always live with the mother and she alone is enough to protect the child’s welfare which is simply unscientific and against nature. It also violates the spirit of the Indian constitution,” Jahgirdar said.
The bill, he said, also allows the mother to claim paternal ancestral property and the children’s share of it, which can also lead to likely misappropriation by step-fathers and step-siblings.
“The government of the people seems to be more interested in women’s rights than innocent children’s rights, simply because children are not vote banks, though they represent more than 40 percent of our population,” he said.
Another member, a software engineer in Nagpur, said, “Men have no platform to lodge a complaint when they face harassment from their wives.”

Most of the time, he said, the wives extort money by lodging false dowry cases and even deny the right of a father to meet his children, even when he has the court’s consent.
“We urge society and its stakeholders to treat fathers with dignity and accept the scientific fact that children deserve their father’s natural love and care as much as their mother,” a statement from CRISP said.

UP accounts for over 80% of illegal arrests in India

UP accounts for over 80% of illegal arrests in India

NEW DELHI: Uttar Pradesh's high-handedness is not just reflected in the arbitrary transfer of officers such as Durga Sakthi Nagpal and slapping of bogus cases against dissenters (as in the case of Dalit scholar Kanwal Bharti), it can also be seen in the massive number of illegal arrests made by the UP police.

According to National Human Rights Commission data, UP records an overwhelming majority of illegal arrests in the country, accounting for more than 80% of all such cases. In fact, it tips its nearest competitor, Delhi, by over 3,000% almost year after year.

In the past three years (April 2010 to July 2013), UP accounted for 3,397 illegal arrests out of 3,950 such cases recorded across India by NHRC. The count for the rest of the 27 states and seven union territories put together was just 553.

"What do you expect from a state where many politicians themselves are criminals? How do you expect them to have any respect for law and order or human rights?" says Colin Gonsalves of Human Rights Law Network.

From April 2012 to March 2013, NHRC recorded 703 cases of illegal arrests in all. As many as 589 of these were against the UP police. UP accounts for 161 of 192 illegal arrests in '13

Its closest rivals in this dubious distinction, Uttarakhand and Delhi, were way behind with 14 cases each. Data for this period shows only two other states where the number of illegal arrests had crossed double figures — Karnataka (12) and Andhra Pradesh (10).

In 2013 too (April 1 to July 20), UP accounted for 161 such cases of the total of 192 recorded by NHRC in the entire country. Its closest rival, Delhi, was again was behind with only five cases.

Year 2011 was the worse for UP, with the state police being at the wrong end of the law 1,101 times of the total of 1,249 cases registered by NHRC. Delhi again took the second spot with 38 cases. In 2010 too UP recorded 1,546 such cases of the total of 1,716. These are cases that were brought to NHRC's notice. The real figures for both UP and other states are bound to be higher as many complainants go to state human rights commissions instead of knocking at NHRC's doors.

Conversely, sources say, UP being closer to Delhi, more people may tend to approach NHRC in the capital. But if that was true, neighbouring Haryana would also show a high number of illegal arrests. However,Haryana's figures for many years have remained in single digits.

Woman arrested for husband's contract killing

Woman arrested for husband's contract killing

MumbaiA 10-year-long marriage ends in tragedy, as the 30-year-old husband is found dead on isolated grounds with injury marks over the body. Friends and relatives naturally sympathise with the young widow. That is till her actual role in the denouement comes to the fore. Cops from Ulhasnagar crime branch have arrested a 25-year-old woman who hired a hit man to get her spouse killed. To mislead the police, she filed a complaint claiming her husband had gone missing and later got a murder case lodged against unknown persons after the body was found.

Shivaji Nagar police had recovered the corpse of an unknown person with injury marks all over at Ambernath MIDC area on January 29. They immediately started checking all the missing complaints and learnt that a 30-year-old who was an electrician and a resident of Manish Nagar in Ulhasnagar was missing and a complaint had been lodged by his wife at Central police station.

"When the wife Preeti Krishnachand Mishra (25), was called she identified the body as that of her husband Krishnachand," said Machindra Chavan, senior police inspector of Ulhasnagar crime branch.

In further investigations, police started questioning Preeti who frequently changed her statements.

"When we inquired about Preeti from her neighbours they told us that some people had seen her roaming around with a 22-year-old youth Jishan Munnar Shaikh, a student of BCom third year," said Chavan.

"Shaikh was then summoned by the Crime Branch and during questioning he broke down and accepted that he and Preeti had given a supari of Rs. 1 lakh to one Akshay Suresh Gaikwad to kill Krishnachand," said Milind Bharambe, additional commissioner of police (crime), Thane.

Akshay's father Suresh Gaikwad is an ex-corporator and is now contesting municipal elections from Ulhasnagar on a Congress ticket.

Priti_Mishra_dead_body_295.jpgAkshay, along with aides Jaysingh Mudaliyar and Damodar Hadalke met Krishnachand on January 28. They drank wine at Bittu Bar in Ulhasnagar and later went to the MIDC area, where the trio stabbed Krishnachand at an isolated place and killed him.

"Preeti had sold all her jewellery to arrange the contract killing of her husband. Preeti was in love with Jishan and was bored with her 10-year-old relationship with her husband who had started drinking," said Meghshyam Dange, police inspector of crime branch.

The miscreants were arrested yesterday and are in police custody.

Tables turn: Men harassed

Tables turn: Men harassed

In 2011, when Ashish (name changed) landed a high-paying government job, his parents were on cloud nine. Little did they know what the future had in store for him: Hikes and promotions being denied because of a 40-year-old divorcee. A married man, Ashish initially could not understand why his boss would often invite him home for dinner, call him to her cabin or ask how she looked?
“It was when she started abusing me in public did I realise that she was angry as I had refused her overtures. She made my life miserable after that. I was loaded with work. And when the time came for hikes and promotions, I was given a bad rating. My hard work turned to dust,” he lamented. Talking to the H R department or other authorities yielded no results. “People would laugh at me. Men being harassed at work places is unheard of. Many presume that a man would actually enjoy it. I had to quit my job when all options were closed,” he adds.
The Ministry of Women and Child Development, in order to implement the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act 2013, which came into being in February, defined some finer details. These state that sexual harassment at a workplace may lead to termination of service of the accused, withholding of promotions and increments, and payment of reasonable compensation to the complainant. However, the Act only provides for aggrieved women, although the offense itself is gender neutral.
“The government is failing to recognise that sexual harassment is not a crime of passion, but a crime acted out to show dominance. In many cases, the aggressor may even be of the same sex,” explains Arnab Ganguly, a member of INSAAF (Indian Social Awareness and Activism Forum), an international NGO specialising in gender and social research, with branches in the United States and India. “The Act, however, does include a provision on “misuse” of the legislation, but it’s a very watered down version. The fine against people who misuse this Act is only `500 or 5 per cent of the aggressor’s salary, which doesn’t really act as a very serious deterrent to perpetrators,” informs Arnab.
The Save Indian Family Foundation along with INSAAF have tirelessly campaigned against the bill, so as to make it gender neutral. The fact that in India the definition of sexual assault incorporates men but the definition of sexual harassment refuses to consider men as victims seems preposterous, especially in the light of the research conducted by Synovate, a market research firm, across six Indian cities. The research states that in Bangalore alone, half of those who confessed to being sexually harassed at work had been harassed by women. Only 32 per cent said they were harassed by male colleagues.
“Although the new Act doesn’t provide for men as victims, most of the internal committees set up by companies to investigate sexual harassment are gender neutral. I usually sit in on many of these meetings as an external adviser and a lot of these cases have been filed by men as well. Companies now are being very open to issues faced by men at the workplace and take them very seriously,” says Kanti Joshi, an advocate who works with SASHA ( Support against Sexual Harassment), the consultancy arm of the NGO, IDEA (Integrated Developmental Education Academy) established to raise awareness and provide support services against sexual harassment.
Mohit Sharma (name changed), a senior architect who was working with a prominent design firm in the city, was fired unceremoniously because of allegations raised against him by a junior designer. “She wanted me to recommend her for a senior position when she clearly wasn’t ready. She flirted excessively and asked me to accompany her on coffee dates and when I didn’t comply she immediately complained to the HR, saying I was mistreating her and also alleged that I had made unwelcome advances towards her, when it was the other way around,” rues Mohit. His complaints simply echoed up the chain of command and were ignored in favour of the woman’s allegations, and after three months of fervent discussions back and forth, he was asked to leave the firm.
Atit Rajpara, president, Men’s Rights Association said that he gets more than 40 calls a month by men recalling horrifying incidents of sexual harassment at workplace.
Recalling a recent case, Rajpara said,” Shashi (name changed), an MNC employee was continuously harassed by his colleague, who wanted to marry him. When he stopped responding to her calls or messages, she landed at his doorstep and created a big scene.” Frustrated by this, Shashi filed a formal complaint with the HR. The woman was let off after a light warning but the harassment continued. She even blackmailed him that if he complained again, she would file a case against him for harassment. Despite repeated complaints, the woman continues to work with the company but Shashi was forced put in his papers. Rajpara added that in most cases men are mocked at when they talk about harassment. He said, “Sexual harassment should not be based on gender. It can happen to anyone, anytime. That’s why men never get justice.”
Women often misuse their rights and blame people at work places to get their way. In 2012, Shrishti Saxena used the same tactics. Being handed too much work by her boss, she decided to teach him a ‘lesson’. Instead of discussing the issue with him, she approached the HR and filed a sexual harassment complaint against him. Serious action was taken against the manager and Shrishti sighed a breath of relief.
Virag Dhulia, head of gender studies, Confidare India, a Bangalore-based research centre said that he gets more than three calls a month by men who have been harassed at work. “Gone are those days when offices were male dominated. These days a lot of women are handling top positions,” he said.
The centre has received calls on cases where women have tried to make advances towards their junior or colleague, asked them to stay back late at work,  threatened higher work burden and used lewd comments or abusive language. “The worst part is that companies don’t take these complaints seriously. The attitude is very insensitive towards men,” he said. Confidare runs a helpline, 9008302822, for those who are victims of sexual harassment.

I enjoyed my stay in jail: James Vasanthan

Popular music director/anchor James Vasanthan was recently arrested for allegedly abusing his 63-year-old neighbour. Now, he is out on bail, and, he opened up to Chennai Times about his arrest. He says, "It was around 3.30 pm on Sunday when cops came into our house. Though initially I was not told about the arrest, later I was informed that I would be held. They didn't even tell me on what charge they were arresting me. Following that, I was imprisoned in Puzhal jail for two days."

He was accused by the woman for displaying indecent gestures in public. Reacting to the allegations, he says, "Some women take the sexual harassment law to their advantage and target innocent men like me. This is not the first case that has been forced on me. I know very well that this woman does everything with the support of the top cop in the city."
Trouble started for the composer when he bought a house in Palavakkam in 2011. "Since then, this neighbour is causing trouble. Her intention is to get our place which she asked us to sell to her when we first bought it. At first, she filed an attempt-to-murder case and now, she lodges a sexual harassment case. I will legally disprove all these false allegations."
James has spent nearly 48 hours in the prison. He says, "I have a positive approach to life; so, I enjoyed my stay in the jail. My wife has been my pillar of strength during this crisis. I will strive hard for justice."

'Harassed' hubbies to meet for men's rights

'Harassed' hubbies to meet for men's rights

Come August 16, Nagpur will be teeming with activists supporting the rights of disgruntled men from across the country. The three-day conference will tackle and debate the government’s draft bill, which contains an amendment in the Marriage Laws Bill.

The national meet, organised by the Nagpur chapter of the Save Indian Family Foundation, will be held at Pench Resorts and is the fifth such national meet after successes in Goa, Shimla, Yercaud and Kolkata in previous years.

The activists will, in particular, be discussing the draft bill on the Irretrievable Breakdown of Marriage Law, which states that if a wife walks out a marriage within six months, she will be entitled to monthly spousal support. Apart from this, she will also be rewarded a portion of the any property the husband may have acquired before marriage, as well as part of his inheritable property, if any.

This bill has sent a panic wave among many young, high-earning men, who have termed the bill as extremely anti-male and anti-marriage.

The conference will also discuss the men’s rights movement and the steps necessary to be taken to increase awareness in this regard, especially to highlight the increasing suicide rate among men, and in particular, among married men.

MRA, SIFF up in arms against new bill on marriage law

MRA, SIFF up in arms against new bill on marriage law

Men’s activists have threatened to carry out nationwide demonstrations outside the houses of those Members of Parliament who support the new Marriage Laws (Amendment) Bill, 2010.
The Men’s Rights Association (MRA) and Save India Family Foundation (SIFF) terms the bill as extremely anti-male, anti-husband and anti-marriage that seeks to incentivise divorce. They have opposed discussion on the bill in the ongoing monsoon session of Parliament as they feel not enough discussion have been done while formulating the bill.
Both the groups insist that the bill, which gives divorced women an equal stake in the husbands’ ancestral property, will result in several damaging results, such as a men being scared of marriage. They also say that it gives the women an unfair advantage. The activists have even declared that not only will they not vote for any MPS who vote in favour of the bill, but also will agitate outside their houses.
MRA’s city president Atit Rajpara said that since the past two weeks, they had met at least 45 Mps and the city Mayor who gave them a memorandum opposing the act. “We will sit outside MPs and politicians who will be seen advocating this Act, and ask them to adopt us and give a share from their properties,” he said.
According to the new law, the wife is entitled to have a share in the husband’s inherited property during the divorce. The decision regarding the monthly spousal support and how the property is to be divided has to be decided by the judges.
SIFF and MRA have asked the government to revise the law and not to table it in the current session of Parliament. The NGOs have also called for a more gender-neutral law that calculates the alimony depending on the woman’s contribution to the household and the duration of the marriage, among other things.
SIFF president Rajesh Vakharia said, “Any marriage law amendment has to be seen in a horrified manner taking into account other laws like shared monthly alimony, parenting, child support and others. The decision has been taken in haste. This will not curb the crime but instead may get misused. There is no provision where a woman will have to compensate to husband and his family if she woman misuse the law. If this act is passed, men will be pinned for life. The man will have to keep paying alimony to his divorced wife even after parting with his own property and ancestral property.”
Today, a man gets married mostly at the age 30, as he waits to become financially stable, with a fair salary, lot of savings and a house. If this act is passed, a male and his family will lose all this in case of a divorce. Females get concession even in income tax, Vakharia explained.
Rajpara said, “We are already witnessing many fake and extortion cases filed by women. The cases are pending for years and if this act comes men will stop marrying. This act was adopted by China, but was ruled out in 2010 after it’s widespread misuse resulted into males in China afraid of marriages. I don’t understand why such atrocities against Hindu husbands only? As per the provisions, the husband will pay 50 per cent property in case of a divorce. The remaining 50 per cent will be lost in the endless court battles. We all need a single civil matrimonial law that applies to all Indians irrespective of religion and gender. Such biased laws will lead to men committing suicide or killing wives instead of fighting legally.”

Supreme Court grants man divorce from wife who crumpled his dress, and life too

Supreme Court grants man divorce from wife who crumpled his dress, and life too

Her cruel behaviour “has snuffed out the bright candle of feeling of the husband”

Crumpling the husband’s ironed clothes or hiding his motorcycle keys to prevent him from going to office may be childish acts, but would constitute ‘mental cruelty’ for grant of divorce, the Supreme Court has held.
A Bench of Justices Deepak Verma and Dipak Misra gave this ruling while granting divorce to Vishwanath Agrawal who sought to break with Sarla for causing him ‘mental cruelty’ — she used to crumple his ironed clothes and sometimes hide them and hide his motorcycle keys to prevent him from going to his factory; gave a false advertisement in a newspaper that he was a womaniser and addicted to liquor and also filed a criminal case against him.
Rejecting the findings of the trial court and the Bombay High Court that there was no direct evidence and that the grounds complained of by Mr. Agrawal were only childish acts on the part of Sarla, the Bench said: “It does not require Solomon’s wisdom to understand the embarrassment and harassment that might have been felt by the husband. The level of disappointment on his part can well be visualised like a moon in a cloudless sky.”
The Bench said: “That apart, in the application for grant of interim maintenance, she had pleaded that the husband was a womaniser and drunkard. This pleading was wholly unwarranted and, in fact, amounts to a deliberate assault on his character. Thus, we have no scintilla of doubt that the uncalled-for allegations are bound to create mental agony and anguish in the mind of the husband. The factual matrix would reveal that the husband comes from a respectable family engaged in business. At the time of publication of the notice, the sons were quite grown up. The respondent-wife did not bother to think what impact it would have on the reputation of the husband and what mental discomfort it would cause [him]. It is manifest from the material on record that the children were staying with the father. They were studying in school and the father was taking care of everything. Such a publication in the newspaper having good circulation can cause trauma, agony and anguish in the mind of any reasonable man. In fact, it can decidedly be said that it was mala fide and the motive was to demolish the reputation of the husband in society.”
The Bench said: “The cruel behaviour of the wife has frozen the emotions and snuffed out the bright candle of feeling of the husband because he has been treated as an unperson. Thus, analysed, it is abundantly clear that with this mental pain, agony and suffering, the husband cannot be asked to put up with the conduct of the wife and to continue to live with her.”
The Bench directed the appellant to pay her Rs. 50 lakh as permanent alimony and allowed his appeal.
