CHENNAI: A 33-year-old painter killed his wife's lover when he found them sleeping together in his house at Maduravoyal here in the wee hours of Sunday.
M Sakthivel, a resident of Rajiv Gandhi Nagar in Alapakkam, left home at 8pm on Saturday after an altercation with his wife, Bhuvaneshwari. He returned home at 12.30am on Sunday and knocked on the door. When the door was not opened, he got suspicious and barged into the house and found Bhuvaneshwari sleeping with his neighbour, Satish.

An angry Sakthivel attacked Satish with a knife and killed him in front of Bhuvaneshwari. Sakthivel's three children were sleeping in the adjacent room when the murder happened.
After the murder, Sakthivel went to the Maduravoyal police station and informed the police about it. They arrested and produced him before a magistrate court in the city on Sunday. The court remanded him in judicial custody.
Preliminary inquiries revealed that Bhuvaneshwari had eloped with Satish a year ago. Based on Sakthivel's complaint, the police then registered a woman missing case and traced her. The police reportedly warned her and asked her to stay with her husband. However, she allegedly continued to meet Satish.
Sakthivel married Bhuvaneshwari 10 years ago.

1 in 10 men in Asia Pacific has raped an unknown woman, finds study

Feminism spread in such way that study results are coming the way they wants to show to others.

LONDON: In a new study to be announced on Tuesday by the British medical journal The Lancet, a survey of more than 10,000 men in Asia Pacific region has found that over 1 in 10 men report having raped a woman who was not their partner.

The number rose tremendously when rape of a partner was included.

Nearly 75% of those who committed rape said that they did so for sexual entitlement and over 50% said they did it for entertainment. Another 50% of men reported having committed some form of physical or sexual violence or abuse against their partner.

Men were surveyed from nine different sites across six different countries: Bangladesh, Cambodia, China, Indonesia, Papua New Guinea and Sri Lanka as part of a UN study on men and violence for prevention of gender-based violence in Asia and the Pacific.

Professor Rachel Jewkes of South Africa's Medical Research Council who carried out the study said, "In view of the high prevalence of rape worldwide, our findings clearly show that prevention strategies need to show increased focus on the structural and social risk factors for rape. We now need to move towards a culture of preventing the perpetration of rape from ever occurring, rather than relying on prevention through responses."

The surveys were performed by trained male interviewers who recorded results onto handheld computer devices with bespoke software. Participants answered the most sensitive questions alone by self-completing audio recordings in response to questions.

Men were not asked directly whether they had committed rape or violence, but were rather asked questions such as, "Have you ever forced a woman who was not your wife or girlfriend at the time to have sex?", or "Have you ever had sex with a woman who was too drugged or drunk to indicate whether she wanted it?"

Overall, over one in ten men surveyed (11%) reported having raped a woman who was not their partner.

When raping a partner was included, this proportion rose to nearly 24%. Of those men who reported having committed rape, just under half (45%) said they had raped more than one woman.

The prevalence of rape perpetration varied widely between study sites. The lowest prevalence of single perpetrator rape of a female non-partner was in rural Bangladesh (3%), while the highest prevalence (27%) was in Bougainville, Papua New Guinea.

The lowest prevalence (2%) of male rape was found in Jayapura and Jakarta in Indonesia while the highest (8%) was again found in Bougainville, Papua New Guinea.

When asked why they had committed rape, 73% of respondents who had committed rape said that they did so for reasons of sexual entitlement.

Over half (59%) said they did it for entertainment, while over a third (38%) said they had raped a woman in order to punish her. Over half (58%) of men who had raped somebody who was not their partner had committed their first rape as teenagers.

Men with a history of victimization especially childhood sexual abuses were more likely to have committed rape than those without such a past.

A history of physical violence towards a partner, having paid for sex, or having had a large number of sexual partners were also associated with an increased likelihood of having committed rape against a non-partner.

Popular music director/anchor James Vasanthan was recently arrested for allegedly abusing his 63-year-old neighbour. Now, he is out on bail, and, he opened up to Chennai Times about his arrest. He says, "It was around 3.30 pm on Sunday when cops came into our house. Though initially I was not told about the arrest, later I was informed that I would be held. They didn't even tell me on what charge they were arresting me. Following that, I was imprisoned in Puzhal jail for two days."

He was accused by the woman for displaying indecent gestures in public. Reacting to the allegations, he says, "Some women take the sexual harassment law to their advantage and target innocent men like me. This is not the first case that has been forced on me. I know very well that this woman does everything with the support of the top cop in the city."
Trouble started for the composer when he bought a house in Palavakkam in 2011. "Since then, this neighbour is causing trouble. Her intention is to get our place which she asked us to sell to her when we first bought it. At first, she filed an attempt-to-murder case and now, she lodges a sexual harassment case. I will legally disprove all these false allegations."
James has spent nearly 48 hours in the prison. He says, "I have a positive approach to life; so, I enjoyed my stay in the jail. My wife has been my pillar of strength during this crisis. I will strive hard for justice."

Consensual sex with minor not a crime, Delhi court says

NEW DELHI: A city court has observed that consensual sex with a girl aged below 18 years does not constitute an offence under the Protection of Children from Sexual Offences (POCSO) Act.

The court said the provisions of POCSO Act suggest that where a physical relationship — which is not in the nature of an assault — takes place with the minor girl's consent and where the consent has not been obtained unlawfully, no offence can be said to have been committed.

Rejecting the plea of the police and Delhi Commission for Women that POCSO Act prohibits minors from having any kind sexual relationship, additional sessions judge Dharmesh Sharma said, "I am afraid if that interpretation is allowed, it would mean that the human body of every individual under 18 years is the property of the state and no individual below 18 years can be allowed to have pleasures associated with one's body."

ASJ Sharma, however, urged state authorities to spread awareness related to unsafe sex or early marriage. "But there lies a greater responsibility on all of us, the state including police in spreading and creating public awareness about the impact of girl or boy marrying at a tender age or indulging in unsafe sexual activities," he said.

The court made these observations while acquitting a 22-year-old youth of charges of kidnapping and raping a 15-year-old girl whom he later married. The youth, a native of West Bengal, was acquitted of the charges as the court held that the minor, on her own will, accompanied him and obstacles should not be put in their happy married life.

"As the evidence indicates, they got married voluntarily with their free consent. Hence no case is made out under section 363 (kidnapping) and 366 (kidnapping or inducing woman to compel her marriage) of the IPC," the court said.

"In my opinion, it would neither serve the object of present enactment (POCSO Act) nor the purpose of criminal laws to hold the accused guilty on the ground that he had sexual intercourse with the girl below 18 years," the judge said, adding that it would not be good for the girl if her husband was sent to jail. The POCSO Act treats girls and boys below 18 years of age as minors.

"It is high time that state authorities, its machinery, NGOs and women groups made a determined and sustained endeavour to reach out to all in schools, colleges and residential places, thereby creating public awareness on various aspects of life in case of marriage at a tender age... besides creating awareness amongst adolescents and young adults about the serious psychological and physical health issues that such a relation entails," the court observed.

According to the prosecution, a complaint was filed before the police on March 5 by the minor girl's mother about her daughter going missing since February 26.

The accused was arrested on March 6 and the girl was also recovered from his custody, it said. The girl, in her statement recorded before a magistrate, said she had willingly gone with the accused to his native place in Kolkata and they got married in a temple there and since then they have been living together.

During the trial, the youth told the court that the girl had accompanied him to Kolkata on her own and they got married there but he denied having physical relations with her. बिलासपुर। ठेकेदार रूपेश अग्रवाल के अपहरण के मामले में पुलिस ने सरगना सहित तीन आरोपियों को गिरफ्तार कर लिया है। एक को पहले ही पकड़ा जा चुका था। पुलिस को अब तक वह युवती नहीं मिली है, जिसने ठेकेदार को झांसा देकर रतनपुर-कोटा रोड में बुलाया था और फिर बाइक की चाबी छीन ली थी। उसकी तलाश की जा रही है।
समता कालोनी निवासी ठेकेदार रूपेश अग्रवाल का 9 अगस्त को कोटा-रतनपुर रोड से दिनदहाड़े अपहरण हो गया था। इस वारदात को एक युवती समेत पांच लोगों ने मिलकर अंजाम दिया था। पुलिस ने अभी तक एक आरोपी जी. श्रीनिवास राव को गिरफ्तार किया था, जो बोलेरो चला रहा था। बाकी आरोपियों की तलाश जारी थी। साइबर सेल ने पकड़े गए आरोपी से पूछताछ की, साथ ही युवती के मोबाइल नंबर की कॉल डिटेल निकाली। आरोपी बिलासपुर में ही रहते थे। साइबर सेल ने इनमें छपरा (बिहार) के ग्राम अरना के राजकिशोर उर्फ राज (25 वर्ष), झारखंड औरंगाबाद बारून के वकील अंसारी (36वर्ष) और भवानी नगर सिरगिट्टी बिलासपुर के गोलू उर्फ लोकेश राव नायडू (24 वर्ष) को गिरफ्तार किया।
राजकिशोर इस वारदात का मास्टरमाइंड था। आरोपी युवती का नाम ममता सिंह है, जो तारबाहर इलाके में रहती है। तारबाहर व रायगढ़ थाने में उसके खिलाफ पहले ही जुर्म दर्ज है। गौरतलब है, ठेकेदार को अपहर्ता झारखंड ले जा रहे थे। इसी बीच अंबिकापुर-पत्थलगांव रोड में बोलेरो दुर्घटनाग्रस्त हो गई और अपहर्ता रूपेश व चालक को छोड़कर भाग निकले। चालक के अनुसार ठेकेदार का अपहरण पांच करोड़ की फिरौती के लिए हुआ था।

ठगी की आरोपी है युवती : अपहरण के मामले में ममता सिंह नामक जिस युवती का नाम आया है, दरअसल उसका घर राजीव गांधी चौक के पास है। वह सिम्स में नौकरी लगाने के मामले में 20 लाख रुपए की ठकी के मामले में भी आरोपी है और खुलासे के बाद से फरार चल रही है। वारदात के समय वह किसी युवक के साथ तारबाहर क्षेत्र में रह रही थी। एक दिन पहले साइबर सेल की टीम उसके घर पहुंची थी और उसके छोटे भाई को पूछताछ के लिए ले गई थी।

रतनपुर-कोटा रोड से अपहर्ताओं में से वकील अंसारी कोटा से युवती को लेकर बिलासपुर आ गया था। राजकिशोर, गोलू व ड्राइवर श्रीनिवास ठेकेदार को लेकर बनारस रोड की ओर जा रहे थे। इसी बीच साइबर सेल ने ठेकेदार के मोबाइल पर कॉल किया। इस नंबर को अपहर्ताओं ने अपने मोबाइल से ट्रेस किया तो उसमें बिलासपुर क्राइम ब्रांच का नाम आया। इससे अपहर्ता घबरा गए और रास्ता बदल दिया। अपहर्ताओं ने अंबिकापुर लौटते हुए जशपुर, पत्थलगांव की ओर गाड़ी रोक दी। अंबिकापुर में गोलू उर्फ लोकेश उतर गया। गाड़ी में राजकिशोर व ड्राइवर श्रीनिवास ही रह गए। पकड़े जाने के डर से श्रीनिवास तेज रफ्तार से गाड़ी चला रहा था और गाड़ी दुर्घटनाग्रस्त हो गई। यहां से ड्राइवर व अगवा ठेकेदार रूपेश को पुलिस अपने साथ ले गई, राजकिशोर भाग निकला। फरार सभी आरोपी शहर आ गए थे और पकड़े गए।

RANCHI: An Odisha girl, who earlier claimed that she was raped near Hatia railway station on July 23 and also that she was a minor, admitted to have cooked up the story to secure compensation after her medical reports false revealed that she neither raped nor was she a minor.

A team of doctors headed by Dr Tulsi Mahto conducted bone age test on the girl at Rajendra Institute of Medical Sciences and reported that she was 19 years old and three months' pregnant.

Counsellor Seema Sharma, who was appointed by Jharkhand State Commission for Protection of Child Rights (JSCPCR) for examining her case, said the girl admitted that she was not raped and had falsely implicated one Pappu Kumar to make her claims look genuine. She said, "The girl revealed that she has been married for the last three years but her husband left her, few months ago. She is pregnant with the child of another man who lives in her neighbourhood. She also said that she lied under parental pressure."

Jagganthpur police station OC Anil Kumar said an FIR had been lodged in the case but when the medical reports arrived and it was found that the girl was lying, the case was closed. He said, "Initially, we lodged an FIR in the case but when JSCPCR and the hospital informed us that the girl is an adult and she was lying about being raped we closed the case"

Member of JSCPCR, Sanjay Mishra said false rape claims have become common, these days. "When we were investigating the Pakur case, where four school girls were gang-raped and compensation of Rs.1.20 lakh was awarded to all these girls, local residents told me that I will get to attend a rape case every day thereafter. No doubt the very next day two girls returned from Delhi claiming that they were raped which turned out to be a fake case again," he added.

Mishra further said it is the compensation money which forces girls to lodge false rape cases under pressure from their guardians. "Under the Schedule Caste and Schedule Tribe (prevention of atrocities) Act, 1989, there is provision of compensating a rape victim with Rs 1.20 lakh," said Mishra.

City lawyers handling domestic and family disputes have welcomed a recent judgement by the Bombay High Court (HC) stating that women filing false rape cases should be prosecuted.

Mens organisations have said that this judgement will help create a gender neutral society and if properly executed will help to bring down the number of rape cases by 70 per cent. They allege that most rape cases are filed after relations break down after consensual sex.

Justice Sadhna Jadhav of the HC on Wednesday observed that women who file rape cases in a fit of rage to fix their partners and later withdraw complaints, should be prosecuted.

She remarked that of late several cases were coming before the HC in which victims filed complaints alleging rape and contending that they had entered relationships after being promised marriage.

In a relationship between consenting adults, sometimes such complaints are filed in the heat of moment and withdrawn later. This has be-come a trend and sends wrong signal to the society, the judge observed on Wednesday.

The court cautioned the police to be vigilant and hold an initial inquiry to find out whether a rape complaint was genuine before registering the case.

The judge was hearing an anticipatory bail plea by Divyesh Vala (35), who admitted that he was in a relationship with a 42-year-old central excise inspector. He pleaded that he was falsely implicated and the case was causing him harm and agony.

The two had met through a social networking site and came close to each other after joining an Art of Living course. The woman alleged that she was raped by Vala, who promised to marry her. However, he married another woman and she felt cheated. Hence, she filed a complaint of rape.

The judge granted anticipatory bail to Vala for the sum of Rs 15,000 and asked him to report to the police station every Sunday until the investigation was over. The judge said it was not inclined to send Vala in custody because no useful purposes would be served in doing so, except satisfying the victim’s vendetta.

Talking to Mirror senior lawyer Milind Pawar said, “Some 90 per cent cases get registered just to satisfy vendetta after break ups. Though such cases are registered it is hard to prove them medically.”

In some cases, the Supreme Court has directed that FIRs in rape cases should be filed immediately, since later on it is difficult to prove it medically Pawar said. “This judgement will certainly teach a lesson to those who use the law to settle their own scores.”

Criminal layer Vijay Pamnani said, “In such rape cases the investigation officer’s role is very important to understand whether rape was actually committed or not. In the said case, the victim being a 42 years old, educated and  working as a central excise inspector knew very well that such a relationship is illicit in Indian society. I believe the HC has passed perfect orders considering facts of the case.”

Atit Rajpara, founder president of the Men’s Rights Association (MRA), Pune said, “Figures of increasing rape cases are only because of such false cases. Some women misuse the law like in domestic violence related cases.

In a recent survey, it was revealed that in Pune over 74 per cent cases of rape are consensual. We welcome this judgement as it has shown sensitivity towards men.”

However, lawyer Shirish Gade has a different opinion. He said, “As a criminal lawyer I believe that if the HC passes such orders against rape victim, those who wish to rape a girl will propose marriage and rape them. Unfortunately, victims won’t come forward due to such orders.

Additionally, in our society girls keep quiet about these serious offences as they are scared of society and fear nobody will marry them thereafter.”

उत्तर प्रदेश के मुरादाबाद में एक नामी कालेज के छात्र-छात्रा के बीच दो साल तक लिव-इन रिलेशन रहा और जब शादी की बात आई तो विवाद शुरू हो गया। मामला थाने पहुंचा।

छात्रा ने अपने रूममेट के खिलाफ बलात्कार का मुकदमा दर्ज कराया है। मामले को निपटाने के लिए कालेज प्रशासन के लोग भी पहुंचे, लेकिन छात्रा टस से मस नहीं हुई। युवक को पुलिस ने हिरासत में ले लिया है।

मूल रूप से सुल्तानपुर जिले की रहने वाली एक युवती मुरादाबाद के एक शिक्षण संस्थान से एमएससी कर रही है। करीब दो साल पहले वह संस्थान के दूसरे कालेज में पढ़ने वाले एमसीए फाइनल इयर के छात्र अभिषेक पाल निवासी लखनऊ के संपर्क में आई।

दोनों एक दूसरे के करीब आए और फिर मिलन विहार कालोनी के एक घर में किराए का कमरा लेकर पति-पत्नी की तरह रहने लगे।

समाज की नजरों में भी दोनों खुद को पति और पत्नी बताने लगे। लेकिन कुछ दिन पहले दोनों में टकराव शुरू हो गया। छात्रा शादी की जिद करने लगी तो छात्र ने इंकार कर दिया।

इसके बाद छात्रा ने शादी का झांसा देकर अपने साथ बलात्कार का आरोप लगाते हुए मझोला थाने में तहरीर दी। पुलिस ने छात्र को हिरासत में ले लिया।

सूचना पर संस्थान के अधिकारी भी थाने पहुंचे और समझाने का प्रयास किया, लेकिन युवती नहीं मानी। परिजनों ने भी समझाने की कोशिश की। समझौता नहीं होने पर पुलिस ने छात्रा का मेडिकल कराने की तैयारी शुरू कर दी। एसओ मझोला ने बताया कि आरोपी को हिरासत में लिया गया है। जांच की जा रही है।

मध्यप्रदेश के इंदौर शहर में एक अजीब सा मामला सामने आया जहां 18 साल की लड़की ने जिला कोर्ट में कहा कि उसकी शादी उसके दुष्कर्म के आरोपी से ही करा दी जाए।

लड़की का कहना था कि उसके मां-बाप एक अधेड़ से उसकी शादी करवा रहे हैं इससे बेहतर है कि मैं अपने दुष्कर्मी से शादी कर लूं।

इंदौर में गौरी नगर की 18 वर्षीय युवती मंगलवार को कोर्ट आई। एक वकील की मदद से फोन कर उसने अपने दुष्कर्म के आरोपी भगवान करण सिंह को बुलाया।

जब वह वहां पहुंचा तो लड़की ने पूरी बात बताई और उससे कहा कि मुझसे शादी कर लो। जब भगवान ने शादी की बात सुनी तो उसने हां कर दी।

False cases are the reasons behind labelling of Delhi as 'rape capital'; a court in Delhi has held while acquitting a 75-year-old man of the charge of sexually assaulting his maid after the woman turned hostile.

The court said after the December 16 gang-rape of a 23-year-old girl in a moving bus lead to the creation of an atmosphere that "the mere statement of a lady that she has been raped, came to be taken as gospel truth, the accused arrested and chargesheeted".

"This lead to an unprecedented surge in filing of false rape cases...It is these false cases which play havoc with the crime statistics, leading to the labelling of Delhi as a 'rape capital'," Additional Sessions Judge Virender Bhat said, while acquitting Bhopal Sharma of the charge of sexually assaulting his maid.

The court observed that as acquittals in such cases are hardly ever reported, the falsely implicated persons lose their honour, dignity and status in the society and though these cannot be restored, "these victims" can be compensated so that they can start life afresh.

It also noted that "it is a matter of intense regret that even the frail, sick and aged persons are not spared from the false allegations of rape".

According to the prosecution, Sharma and his neighbour Anita had become friends when they met in a hospital  where his ailing wife was admitted. After his wife's death, Anita had arranged for the woman, who was in her 30s, to work as a maid in his home.

The maid in her complaint had said a few days after she started working at Sharma's house in July 2012; he had raped her and after the incident, had promised to marry her.

Thereafter, he continued to have sexual relations with her on the pretext of marrying her, the maid had alleged, adding that she lodged the police complaint on October 11, 2012 after Sharma expressed his unwillingness to keep his promise.

However, during the trial, the woman turned hostile and said she had levelled false allegations on the advice of Anita and another person Kuldeep.

While acquitting Sharma, the judge noted that the maid, a divorcee, had levelled the allegation of rape against the senior citizen on the behest of her neighbour Anita and Kuldeep in order to usurp the man's property.

Expressing the need for courts to be empowered to award compensation to victims of false rape cases, the judge also lamented that media turns a blind eye to acquittals in such cases.

"Nobody bothers to see in how many cases the accused in fact are convicted. Media turns a blind eye towards acquittals. The acquittal of an accused is not noticed at all and he continues to be labelled as a 'rapist' even after his honourable acquittal.

"Their lost honour, dignity and status in the society cannot be restored but they can be compensated so that they are able to start life afresh. The courts need to be empowered to award compensation to men acquitted in false rape cases," the court said.

The judge also said right from the first day when accused was produced before him, he had wondered, "How such a frail old man, who cannot even stand straight, would rape a young lady in her mid-30's, having lot more strength than the accused?"

A 40-year-old woman, who is reportedly a complainant in 11 cases of rape, stalking and other sexual offences, was arrested on charges of extortion by the East district police on Friday.
Incidentally, the man who filed the extortion complaint had been earlier charged with raping the woman.
Investigations began when the police received a complaint from one Sushil Kumar, who lives in Pandav Nagar area of East Delhi. On March 28, Sushil Kumar registered a case of extortion against the woman, claiming that she had falsely implicated him in a case of rape that was registered against him on February 19.
In his complaint, Sushil said he had befriended the woman three months ago. He told police that the woman told him that a case of rape against her husband was pending before the Karkardooma court and asked him to lend Rs 10,000 on the pretext of paying the court fee.
Sushil gave her the money, and she promised to return it soon, he said in the complaint.
A month later, Sushil asked her to return the money. When Sushil went to her house, the woman, he claimed in his official statement to the police, threatened to implicate him in a false rape case, assaulted him, snatched his mobile phone and Rs 5,000.
She then dragged him to the police station, where she registered a case under Section 376 of the IPC, following which Sushil was sent to jail.
However, after he was released on bail in March, Sushil filed an application in court requesting that his statement be recorded.
He registered a case of extortion against the woman, which was later ascertained to be true, police said.
Additional DCP (East) D K Gupta said: "The previous case under Sections of rape that the woman registered against Sushil was found to be false. On the directions of the court, a case of extortion based on Sushil's complaint was registered and the woman, arrested. She has been sent to 14 days judicial custody."

COIMBATORE: Judicial magistrate S Thangaraj, who was arrested on Saturday on charges of raping a female sub-inspector, got bail from the Tirupur district and principal sessions judge's court on Monday. The bail order was served to the Coimbatore Central Prison and the magistrate was released on Monday evening. "He will take charge on Tuesday at the fast track court in Coonoor," his lawyer, Bhavani B Mohan said.

Thangaraj was arrested from ThattanKuttai near Kumarapalayam in Namakkal district on Saturday and sent to judicial custody after a female sub-inspector lodged a complaint with the Palladam all women police station, alleging that he had a physical relationship with her for more than a year after promising to marry her. The Palladam all women police station registered a case against the magistrate under Sections 376 (rape), 417 (cheating) and 506 (i) (criminal intimidation) of the IPC.

Thangaraj filed a bail petition before the Tirupur district and principal sessions judge's court, which came up for hearing on Monday before judge K Ganeshan. Public prosecutor KN Subramaniam argued that police had followed the rules and regulations of the Supreme Court and Madras high court in registering the case and, hence, the accused should not be allowed to enter the Nilgiris and Tirupur districts till the police investigation was completed.

Senior advocate Bhavani B Mohan, appearing on behalf of Thangaraj, argued that the woman SI had lodged a complaint with the Palladam all women police station on June 21 and that the case was registered on June 29. Police arrested the magistrate on Saturday and slapped rape charges on him. The charge does not apply in this case as they were in a relationship with mutual consent. The magistrate was not even told about the grounds of arrest. Mohan termed the incident as an assault on the judiciary and pleaded to the court to release Thangaraj.

Judge Ganeshan granted bail after the arguments concluded. Thangaraj, 31, of Oonjapalayam in Erode district is judicial magistrate at the fast track court at Coonoor in the Nilgiris district. He had allegedly been in a relationship with the woman sub-inspector attached to Palladam police station. The Mahadevapura police on Friday arrested a 23-year-old woman in connection with the death of software engineer S. Sreerag (25), whose body was found in his car in AECS Layout, off Whitefield, Tuesday morning.

The police said the arrested woman was Gayathri alias Jennifer, a K.R. Puram resident and a team leader with a telemarketing firm in Indiranagar.

Deputy Commissioner of Police (East) T.G. Krishna Bhat said she has been charged with impersonation.

The police suspect that HP employee Sreerag, a native of Kozhikode in Kerala, committed suicide after his marriage proposal was turned down by Gayathri, whom he had met on a social network website in January. She had introduced herself as Jennifer and had emailed her friend's photograph to him, claiming that it was her. A smitten Sreerag started texting and chatting with her without ever seeing her.

When he proposed marriage a few days ago, she turned him down saying she was engaged to a London resident. A dejected Sreerag, police suspect, ended his life. He was found on the rear seat of his car near a park in AECS Layout where he had rented a house. His face was covered with four plastic covers and sealed with several layers of duct tape. A teddy bear, purportedly a gift for Jennifer, was found in the car.

Pune: Upset over the latest amendments in the Hindu Marriage Act which virtually give wives a final say in divorce 

 

cases, Men’s Rights Association (MRA) on Saturday staged a protest against the legislation which they term as 'draconian'.

 

"The bill has a provision giving power to the courts to not grant a divorce unless the wife was paid adequate amount of 

 

money in the name of financial security of the woman. Such powers may result in harassment of men," MRA president Atit Rajpara said.

 

He also said the bill also provides special powers to wives to oppose the divorce if she was unhappy with the money she received from the husband under section IPC 498 (A), domestic violence act and several other maintenance laws.

 

According to the MRA, such clauses are outright anti-male and gender-biased and therefore men’s rights activists and organisations are opposing them. Rajpara said the mens’ rights organisations want the bill to be gender-neutral.

In a landmark decision in 2010, Preeti Gupta v. State of Jharkhand, the Supreme Court of India lambasted the prevalent abuse of the infamous Section 498a of the Indian Penal Code law demanded that the legislature should change the law and directed that a copy of its decision be sent to the Law Commission of Indian the hope that the legislation might be amended.

The Law Commission issued a report in August 2012, calling for quite modest changes in the law. However, even those changes have not yet been enacted.

In Gupta the Supreme Court demanded that lower courts intervene to prevent the rampant consequential abuse of process, which has “led to enormous social unrest affecting peace, harmony and happiness of the society”; ruled that “most” 498a cases are filed in the heat of the moment over trivial issues without proper deliberations; asserted that many such cases are not bona fide, that many are filed with an oblique motive, and that many are filled with exaggerated or false claims; explained that these cases “can lead to insurmountable harassment, agony and pain to the accused and to his close relations” and “immense sufferings for all concerned;” and stated further that an ultimate acquittal may “not be able to wipe out the deep scars of suffering of ignominy.”

Meanwhile the abusive conduct continues. The Law Commission reported that in 2010 there were at least 340,555 cases under Section 498-A that were pending trial in various courts towards the end of 2010 and that there were as many as 938,809 people who were implicated in these cases. The reason that there were almost three times as many people accused as there were cases is that the law expressly authorizes a wife (but not a husband) to ask the police to bring charges against all of the relatives of her husband who may have participated in the alleged acts of cruelty.

GURGAON: Gurgaon police on Friday nabbed the key accused in the Thursday early morning rape in a moving car, bringing the total number of arrests in the case to six. The accused has been identified as Dharambir, and it was he who planned the rape to get value for the Rs 10,000 he had paid to the two victims and also raped one of them.

The Toyota Corolla Altis car in which the two women were raped by the accused has been retrieved and the five persons who were arrested on Thursday were sent in judicial custody on Friday. Dharmabir had been trying to get to girls over the past week but when he couldn't he got a friend to lure them to get into his car and then carried out the rape of the victims. Police are currently interrogating him about the whereabouts of last of the seven accused, Vikram, who is at large.

"Dharambir, 27, is a native of Dor Kalan village near Narnaul and used to work as a taxi driver. We recovered the Corolla Altis car, which was used in the rape. We found out during the interrogation that the accused had raped the victims without using contraceptives. There is a possibility of getting strong biological evidence against the accused from the car," an investigating officer said.

The victims of the horrific incident were two Delhi-based women who had hired a private cab a little after 12.30am on Thursday after finishing their work in a pub. The two residents of Tughlakabad had left Empire Club in Metropolitan Mall on MG Road at 12 midnight. Sources said that the two were entry "escorts" and regulars at the club for three days in a week and would help boys to gain the cheaper "couple entry" and avoid the expensive "stag entry".

On the same day police arrested five of accused, identified as Devender, Parmod, Harish Khan alias Nisar, Satish and Devinder. One of the accused is a native of Mewat district while the other four belong to Nangal Peepa village in Mahendergarh distirct. An Indica car has been retrieved from them. One of the two victims, who is 27 years old, told police that they had come out of Empire Club a little after midnight and reached in front of Club-18 in an auto.
