Accused of molestation by daughter-in-law, man commits suicide, blames her

NAGPUR: A senior citizen, who had been booked for outraging the modesty of his daughter-in-law, committed suicide by consuming poison. Gajendra Malviya was declared dead on Wednesday at a private hospital. In his suicide note, he blamed the daughter-in-law and her relatives for the drastic step that he had taken.
The 65-year-old Malviya was out on an ad-interim bail after being made an accused in the molestation case. After that he returned to his house and continued to stay with the daughter-in-law.

The molestation complaint was filed on May 2 at the Kalamna police station. She had stated that Malviya had been making undue advances towards her in husband's absence.
Police said that the woman got married to Malviya's son in 2010. Due to alleged harassment by Malviya, she left soon after and returned to her parent's house in Paratwada (Amravati). Last year, she returned to Nagpur on being persuaded by the Malviyas. According to her, Malviya did not improve his behaviour which prompted the woman to lodge a police complaint.
A few days ago, the daughter-in-law was again set to lodge an FIR against Malviya and, his wife and son for harassment.
An upset Malviya then consumed poison on Wednesday and was rushed to a private hospital in Wardhaman Nagar where he was declared dead. Police said that Malviya had indicted his daughter-in-law and two of her close relatives for trying to implicate him and his family in more cases.
Senior inspector Sampat Chavan of Kalamna police station said that the suicide note is with the cops. "At present the matter is under investigation. No decision on registering an offence has been taken," he said.

KOLKATA, 6 JUNE: A youth from Haryana wrote to the President of India seeking his approval to sell his organs to pay his wife who had allegedly filed a "false" dowry case against him. The matter is now under consideration of the National Human Rights Commission.
Mr Sunil Kumar (in sns photo), a resident of Fatehgarh in Haryana, married on 26 June in 2009. A year after his marriage, his wife brought dowry harassment charges against him and asked him to pay maintenance.
According to Sunil, his wife brought "false" charges against him for monetary gain. Though he collected proof against the false claims through RTI application, it was ignored by the local court, he alleged in his letter to the President.
Sunil wrote the letter in May this year to the President explaining his financial constraints and how he is overburdened with loans. He said in his letter that since he is unemployed and has nothing to sell to pay the maintenance to his wife, he would like to sell his organs.
"Please permit mercy killing (euthanasia) for me and sell my body parts and organs so that my wife receives her maintenance," he wrote. The matter is now before the National Human Rights Commission.
Talking to The Statesman from Haryana, Sunil said that after his wife filed "false" dowry case against him in 2010 she "continuously blackmailed me to pay her Rs 10 lakh to settle the matter." Expressing his poor financial condition he surrendered to the police on 9 August 2010 and spend two days in judicial custody.
"But that was the beginning of our suffering. The judge even after knowing my mother's poor health sent her to judicial custody for four days. My mother who was discharged from hospital after a major tumour operation suffered paralysis after spending four days in Hawalati ward without medicine, food and proper care," Sunil said.
He said that in spite of bringing the facts with relevant proofs before the court, the judge did not consider them. "I even submitted evidence against the false charges collected through RTI Act. But even after her false claims without any evidence she got order in her favour," Sunil said. "But now I hope justice will be given as the matter is taken up by the NHRC. Otherwise, I don't have any option other than selling my organs to pay my wife," he added.
Mr Amarty Talukdar  of Save Indian Family Foundation (SIFF), said that extortion of money by abusing the dowry law is now rampant in India. "We are daily flooded with complaints from husbands who are falsely charged by their wives often to get financial advantage. The government should act now to stop its misuse," he added.

A hardware engineer was jailed following a dowry harassment charge in Sept 2010. Using the complaint as evidence, he has now filed a police case against wife and in-laws, seeking that they be punished for the offence of paying dowry

Manjunathan Padmanabhan, a hardware engineer, spent three harrowing days in Parappana Agrahara, sharing cell space with thieves and murderers. His crime? Accepting dowry. Now, in perhaps a first-of-its-kind case, the 34-year- has turned the tables on his wife and her family by filing a counter complaint for giving him dowry.
 
The Dowry Prohibition (DP) Act states that both giving and accepting dowry is an offence punishable by law, and Section 3 of the Act speaks about the “penalty for giving or taking dowry”. But while cases of husbands and their family members spending time in jail for receiving dowry are dime a dozen, rarely — if ever — has a dowry giver been punished. 
 
In his complaint against his wife and in-laws, Padmanabhan, a resident of Ulsoor, has used the same statements made by his wife's relatives in their complaint against him three years ago. Ulsoor police registered an FIR on April 17.
 
In his complaint, Padmanabhan states that he was married to R Ashwini on September 2, 2009. His wife had filed a complaint against him on September 8, 2010 stating that she was harassed for dowry and that Padmanabhan was paid 119.75 grams of gold, 11 pieces of silverware and cash of Rs 25,000, Rs 1,000 and Rs 10,000 on January 2, 2010, July 5, 2010 and July 20, 2010 respectively. A case was filed against him under 498(A) of the IPC and under Sections 3 and 4 of the Dowry Prohibition Act. 
 
In her complaint, Ashwini claimed that she and her family had also given Padmanabhan a suit in dowry. Her brother's statement claimed they had given cash on three occasions. The complaint was filed in the same police station (Ulsoor) and the complaint and the memo of evidence given by his in-laws are part of the station records. He claims he obtained all the necessary documents from the station through the Right to Information Act. 
 
Padmanabhan is now seeking action against all family members who admitted to giving him dowry. “Since offenders and abettors themselves admitted/claimed to have given dowry, it is submitted further that all these records and details are already with you,” Padmanabhan has stated in his complaint. 
 
Speaking to Bangalore Mirror, Padmanabhan said, “My father-in-law is a Central government employee. He knows giving dowry is a crime. He, along with his family, has admitted to giving me dowry. That is the crux of their complaint and police statements against me. They have admitted to committing a crime before a police officer and the police have to take action against those persons. I am only stating what the law says.”
 
When contacted for his reaction, Ashwini's father, A Ramesh Babu, the main accused in Padmanabhan’s complaint, said, “I have not paid any dowry to him. Only a complaint of harassment for dowry was filed. The police might have changed my statement and added that I paid dowry. I do not know about the complaint filed against me.”
 
AK Mohan Krishna, an advocate who specialises in matrimonial disputes and who is unconnected to this case, said, “This is the first time that the police have registered a FIR against the wife's family for giving dowry. If it is only a demand for dowry, then only the provision of IPC Section 498(A) comes into play. If the wife and her family members have admitted to giving dowry, then they have committed a crime under the Dowry Prohibition (DP) Act. If they have stated that they have given dowry, they are clearly pleading guilty here. Though this provision of punishing those who give dowry is in the Act, in reality it has never been invoked. The same Act is used to punish husbands and their families who receive dowry. Police usually do not take such complaints. But this case seems to be very promising for men who are accused of taking dowry.” 
 
Ulsoor police said, “He (Padmanabhan) was jailed on a case of dowry harassment and he has now filed a complaint against his wife and in-laws. We are investigating the case.”

Mumbai: Ever since the news of Nafisa alias Jiah Khan’s suicide has surfaced, days have been very hard on the Pancholi family. Actor Aditya Pancholi says his son Suraj, the late actress’s boyfriend, is being made the “villain” in the story for no reason.
Jiah, 25, was found hanging in her Juhu residence on 4 June. Suraj is being questioned in the matter as the actress was reportedly depressed due to her failing Bollywood career as well as a crumbling personal life.
“If Suraj is to be blamed then please make him the villain,” says protective father Aditya.

In a recent blog post, writer Shobhaa De recently commented: “Like father, like son” in reference to Aditya and Suraj. Aditya is clearly unhappy.
“What’s Shobhaa De’s problem with me and my son? What does she mean by saying, ‘Like father, like son?’ Let the truth come out.
If Suraj has done some wrong, let it come out. But don’t condemn him in your column for something he hasn’t done. Everyone has children,” said the hurt father.
Taking a deep breath, Aditya relives the nightmare of a death so close to the family.
He said: “Suraj ki kya galti hai (What’s Suraj’s fault)? They’re probably looking for a villain in this story, and Suraj has been selected as the villain of this story. If you take Raavan out of the ‘Ramayan’, it loses its impact. What is ‘Sholay’ without Gabbar Singh?”
“For the last three days, I’ve done what I could do as a concerned father and the head of my family. Now I’ve the space to see what loss has Jiah’s family suffered. We were there – my son Suraj and I, for the funeral. Not for a second did we think we should stay away just to avoid trouble.
“Jiah and her mother (actress Rabiya Amin) are our friends. We are not going to turn our backs on them just because some questions are being asked by some people who don’t know the truth and are only interested in being judgmental,” he added.
Aditya says his son is going through a rough time.
“Suraj is very hurt and shaken. But what can he do? I know Suraj will be fine. But what about Jiah’s mother and sisters? Would they ever be normal again? Looking at Suraj’s grief, I am reminded of Jiah’s family’s grief,” he said.
Aditya also believes it’s wrong to blame only the broken relationship between Jiah and Suraj as the reason for her suicide.
“There must be other factors. Jiah bottled up all her emotions. Suraj tells me she never raised her voice. He says the maximum she ever raised her voice to say was, ‘Suraj, this is not done’.
“I want to request people to not try to make my son the villain. It’s circumstances that played villain in Jiah’s life. If that one moment when she took that drastic step had been averted, she’d still be alive,” he added.

HDFC Bank’s 30 year home loan Jaipur, June 6: Peeved over the marriage of her boyfriend, a 25-year-old woman with an intention to land him in trouble sent an e-mail to Chief Minister's office and Jaipur police threatening a bomb blast on June 13. Police said Ritu Sharma had an affair with Amit Jain, who was married to some other girl some time back. Annoyed over the issue, Ritu sent the e-mail from a fake id to Chief Minister's Office, DGP, Jaipur Police commissioner and other police officers yesterday. "The sender unspecifically mentioned the name and postal address of Amit, resident of Pratap Nagar, in the e-mail and said that a letter having information about the plan of bomb blast in Jaipur on June 13 was about to be delivered to him," Additional Police Commissioner Girraj Meena said. "It was also mentioned in the e-mail that there were information related to Army cantonment in the letter following which the Army as well as Central Intelligence authorities were informed and investigation started by police," he said. A police team rushed to the postal address mentioned in the email and held Amit. He expressed ignorance about such e-mail and letter and suspected that her former girlfriend Ritu may be behind this, police said. Meanwhile, the IP addressed of the computer which was used to create and send the e-mail was traced to a cyber cafe in Vaishali Nagar. The cyber cafe owner verified that a woman named Ritu had visited the cafe yesterday. Thereafter, the woman was today picked up for questioning and later placed under arrest under IT Act for her involvement in the matter, police said. Ritu is an MBA degree holder and presently unemployed, DCP (West) Dr Ravi said.

A city court has asked the Delhi Police to conduct an investigation into the role of a prominent NGO after a "rescued rape victim" told the court that a worker from the NGO had "tutored" her and told her to falsely depose that she had been raped by her employer, a businessman.

Additional Sessions Judge Nivedita Anil Sharma on Saturday acquitted the businessman — a Punjabi Bagh resident — of the charge of rape.

The court also noted that though the NGO Shakti Vahini had been associated "in over a thousand cases", this case was the first instance in which the NGO had gotten involved to the extent of filing an application for the cancellation of bail of the accused.

The businessman had been granted bail to conduct the last rites of his mother, after spending 72 days in jail. The NGO had filed an application seeking the cancellation of bail.

The court dismissed the application and noted that the NGO had no locus standi to file a petition regarding the bail of an accused.

During arguments, the court found that the woman, who was sent to the Nirmal Chhaya women's home, had written to superintendent of Nirmal Chhaya and that her employer had not raped her.

The prosecution said the woman, who hails from Assam, was a minor and was "rescued" by the NGO and police from the Punjabi Bagh home of the businessman in October 2012.

It said the woman had told police that she was being forcibly kept at the businessman's home for three years with very little pay.

The prosecution had chargesheeted the businessman for rape and under the anti-human trafficking and anti-bonded labour laws.

The chargesheet also said the woman had given a statement that she had been raped numerous times by businessman, who had also "given her some tablets" after raping her.
