Daughters-in-law abuse elderly more, says HelpAge India study

Daughters-in-law are the worst abusers of the elderly in homes in Thiruvananthapuram, a study conducted by HelpAge India says.

The study, covering 24 cities including the Kerala capital, released here on Friday, says that daughters-in-law constituted 44 per cent of the abusers, followed by daughters (32 per cent) and sons (24 per cent). The study was released to mark World Elder Abuse Awareness Day on Saturday.

The report says that the elders’ perception of abuse constituted neglect (38 per cent), economic exploitation (27 per cent), and disrespect (35 per cent). Among the abused, 24 per cent made an attempt to report it, their first choice being a community leader. Their second choice was the local police and the third choice relatives, friends, and NGOs.

Those who did not report abuse did so in order to maintain confidentiality of family matters; ignorance about the best way to deal with the problem; or lack of confidence in the ability of the person or agency.

Twenty two per cent of those surveyed reported experiencing abuse, 34 per cent of them experienced abuse for three to five years. For 33 per cent of the respondents, abuse was a daily experience. Among those who reported abuse, 89 per cent of the elderly belong to age group of 60-70 years, 10 per cent to 71-80 years. The mean age of those who reported abuse was 65 years. Forty five per cent of respondents were postgraduates, 25 per cent graduates. Among them, 85 per cent were married and 14 per cent were widows or widowers, the study says.

While the people across the nation might have celebrated Independence Day on Thursday in solidarity with the traditional practice, a handful group of men acted otherwise. Feeling leftover in the series of issues pertaining to individual rights, husbands have moved a step forward in affirming their self in their own right and marked Friday as their day of ‘Independence’. The city of Nagpur would be a part of the one of its kind revolution which is running into its fifth year.
5^th National Men’s Rights Conference 2013, an event jointly conducted by a group of organizations fighting for equal rights to men in Hindu marriages would be held Friday at
Pench Jungle Home Resort near Nagpur.
Arnab Ganguly, a member of one of the participating organization called INSAAF told Nagpur Today, “We have found Nagpur as our strong chapter. We have got strong support from over 3500 members here. It is centrally located and easier to reach. So this year we have chosen this venue for conducting our event.
He told Nagpur Today, “On Friday we will be conducting the conference while tomorrow we would be debating on marriage laws.”
He informed that last year we could not conduct the event as we had moved to Delhi to press for the amendments in Hindu Marriage Bill. “Our previous events were conducted in Shimla, Kolkata and Yercaud in Tamil Nadu. We are fighting for the men’s rights as the provisions of current Hindu marriage bill are extremely dangerous and essentially targeting men in Hindu marriages. It allows wives to acquire 50% of the ancestral property. Even when the Hindu man is not married, 50% is accorded to his wife although she has not contributed in the property. This is very dangerous act which affects Hindu families badly. It will push husbands to become criminals. We want the government to make amendments but it did not pay any heed. Even the proposal is awaiting to be tabled in Lok Sabha or Rajya Sabha. It would be put up by Monday or Tuesday,” he said.
Another organization Child Right Initiative for Shared Parenting (CRISP) working towards the equality of parenting rights among married men and women is participating in the movement to push the envelope further.
Kumar Jahangirdar, founder and president, CRISP said, “We did not participate in the celebrations Thursday to mark the country’s Independence Day. We, a group of men who are seeking parenting rights and joint custody of their child, are meeting in Nagpur on Friday to demand ‘freedom’ from women-centric laws.
Over 100 men from across the country would participate in today’s movement. CRISP, which has been fighting for the rights of fathers and children for more than five years, in partnership with Save Indian Family, has organised this annual event which would be conducted for fifth year in a row.
Among the issues slated for discussion during the summit are Marriage Laws Amendment Bill of 2010. “The law makers have an assumption that children always live with the mother and she alone is enough to protect the child’s welfare which is simply unscientific and against nature. It also violates the spirit of the Indian constitution,” Jahgirdar said.
The bill, he said, also allows the mother to claim paternal ancestral property and the children’s share of it, which can also lead to likely misappropriation by step-fathers and step-siblings.
“The government of the people seems to be more interested in women’s rights than innocent children’s rights, simply because children are not vote banks, though they represent more than 40 percent of our population,” he said.
Another member, a software engineer in Nagpur, said, “Men have no platform to lodge a complaint when they face harassment from their wives.”

Most of the time, he said, the wives extort money by lodging false dowry cases and even deny the right of a father to meet his children, even when he has the court’s consent.
“We urge society and its stakeholders to treat fathers with dignity and accept the scientific fact that children deserve their father’s natural love and care as much as their mother,” a statement from CRISP said.

विवाह सुधारणा कायदा विधेयक २०१० ला जे खासदार पाठिंबा देतील, त्यांच्यावर देशभरात बहिष्कार टाकण्याचा इशारा मेन्स राइट असोसिएशनने (एमआरए) दिला आहे. हे विधेयक पुरुषांवर अन्याय करणारे, पतीविरोधी आहे. ते पारित झाल्यास देशात घटस्फोटांचे प्रमाण वाढेल. कुटुंबे तुटतील, असे 'एमआरए'चे म्हणणे आहे.

देशभरातील पुरुष अधिकार कार्यकर्ते या विधेयकाविरोधात रस्त्यावर उतरत आहेत. या कायद्यातील तरतुदीच इतक्या भयंकर आहेत की, हे विधेयक संमत झाल्यास पुरुष लग्न करणेच थांबवतील. या कायद्यामुळे कुटुंबांचे विभाजन होईल, घटस्फोटांचे प्रमाण वाढेल, विवाह म्हणजे संपत्ती हस्तांतरण ब्यूरो होईल, महिला संपत्तीसाठीच लग्न करतील आणि ती मिळाली की लग्न मोडून टाकतील. या कायद्यामुळे समाजात हिंसाचार वाढेल. कारण पती-पत्नीचे आपसात पटत नाही, या कारणावरून कष्टाने मिळविलेली संपत्ती पत्नीला देऊन टाकावी लागेल. त्याचे अनिष्ट परिणाम होऊ शकतात, या कायद्यामुळे समाजात महिलांची भीती आणि त्यांच्याविषयी द्वेष निर्माण होईल, विवाहित पुरुषांच्या आत्महत्यांचे प्रमाण वाढेल, अशी भीती संघटनेने व्यक्त केली आहे.

त्यामुळे सरकारने या अधिवेशनात हे विधेयक संमत करू नये, असेही आवाहन संघटनेने केले आहे. या विधेयकात अनेक त्रुटी आहेत. संसदेत त्यावर चर्चा होऊन त्या त्रुटी दूर करण्याची गरज आहे. जे खासदार संसदेत या विधेयकाच्या बाजूने भूमिका घेतील, त्यांच्यावर पुरुष संघटनांचे कार्यकर्ते बहिष्कार टाकतील व येत्या निवडणुकीत त्यांच्या विरोधात मतदान करतील, असेही जाहीर करण्यात आले आहे.

काय आहे विधेयक? हा हिंदू विवाह संशोधन दुरुस्ती कायदा-२०१० आहे. याअंतर्गत घटस्फोटाच्या वेळी पत्नीला पतीची ५० टक्के संपत्ती मिळते. तसेच वडिलोपार्जित संपत्तीतील हिस्साही मिळतो. यात पतीला काहीही बोलण्याचा वा आक्षेप घेण्याचा अधिकार नाही. विशेष म्हणजे ही संपत्ती ढापण्यासाठी वेळेची निश्चिती नाही. लग्नाच्या दुसऱ्या दिवशीही पत्नी संपत्ती घेऊ शकते.

मानवी हक्कांचे उल्लंघन करणारे हे विधेयक आहे. फक्त आणि फक्त महिलांचाच विचार करणारे हे विधेयक हाणून पाडण्याची आमची तयारी आहे. त्यासाठी या विधेयकाला समर्थन देणाऱ्या खासदारांना 'टार्गेट' करू. एकीकडे महिला सक्षमीकरणाच्या गप्पा मारायच्या अन् दुसरीकडे दुसऱ्यांच्या आयत्या संपत्तीवर डल्ला मारण्याचा भिकारडेपणा करायचा, असा हा मामला आहे. -राजेश वखारिया, मध्य भारत अध्यक्ष, सेव्ह इंडिया फॅमिली फाउंडेशन.

A 30 year old man hanged himself at his house today morning; his family blamed his wife and her family members for allegedly provoking him for committing suicide on the issue of five lac rupees.

Ashok Yadav, resident of Yadav Colony, was seen hanging in his room today morning at 7.30 am by his mother who immediately informed other family members. The victim was rushed to the hospital but he was declared dead by the doctors.

Yogesh Yadav, brother of the deceased, has lodged a complaint against Ashok’s in-laws and his wife  for pressurizing Ashok for Rs. 5 Lac failing which, they would complain against him under Mahila Pratarna, said police.

Yogesh informed that, “My brother got married last year. On the very next day, his wife went back to her house at Nathdwara and never came back. Her family members often threatened Ashok for five lac rupees in cash for breaking the marriage.”

Yogesh also informed that the girl was already married to somebody else before getting married to his brother Ashok.

On the other hand, Ashok’s in-laws said that Ashok was not physically fit and they wanted their daughter to divorce him. “There was no issue of cash”, informed Navratam Yadav, Father-in-law of the deceased.

Police has registered the case and started investigating it.

कानपुर, हमारे संवाददाता: ससुराल वालों की प्रताड़ना से पीड़ित युवक ने न्यायालय भवन की पांचवी मंजिल से कूदकर जान दे दी। तलाशी के दौरान जेब से मिले सुसाइड नोट में उसने इसका जिक्र किया है। ससुराल वालों के खिलाफ उसने एसएसपी से गुहार भी लगाई थी।
न्यायालय भवन में शनिवार अपराह्न डेढ़ बजे एक युवक के पांचवी मंजिल से छलांग लगाने के बाद हड़कंप मच गया। सूचना पर कचहरी चौकी इंचार्ज अखिलेश गौड़ मौके पर पहुंचे और युवक को उर्सला ले गए जहां डाक्टरों ने उसे मृत घोषित कर दिया। तलाशी के दौरान मृतक की जेब से एक प्रार्थना पत्र व एक समाचार पत्र का आईकार्ड मिला। प्रार्थना पत्र के पीछे मृतक ने सुसाइड नोट भी लिखा था। पुलिस ने प्रार्थना पत्र पर लिखे पते पर सूचना दी तो फीलखाना निवासी अमित गुप्ता ने मौके पर पहुंचकर मृतक की शिनाख्त छोटे भाई अनुज गुप्ता के रूप में की। अमित के मुताबिक अनुज कैनाल रोड स्थित अपनी दुकान में थे। पूर्वाह्न 11 बजे एक फोन आया जिसके बाद वह बिरहाना रोड जाने की बात कहकर चले गए। अपराह्न 1:30 बजे पुलिस ने घटना की जानकारी दी।

ससुराल वालों से था प्रताड़ित
बड़े भाई अमित के मुताबिक अनुज की शादी चार साल पहले इटावा बाजार की प्रगति संग इस शर्त पर हुई थी कि वह उसे लेकर परिवार से अलग रहेगा। प्रगति विदा होने के बाद ससुराल न आकर किराए के घर में रहने गई थी। परिवार से अलग रहने के कारण अनुज पर ससुराल वालों का दबाव था। वह अक्सर उसके साथ मारपीट करते थे। इस बात का जिक्र अनुज ने 22 जून को एसएसपी को दिए प्रार्थना पत्र में भी किया था। पत्र के मुताबिक 16 जून को उसकी गैर मौजूदगी में ससुर राम बिहारी, सास शीला, साढू़ प्रशांत कई लोगों के साथ घर आए थे। एक लाख नकद व सोने के गहनों के साथ पत्नी को लेकर चले गए थे। उसने ससुराल वालों से संपर्क किया तो उन्होंने जान से मारने की धमकी देते हुए कहा कि जब तक अपनी दुकान में साढ़ू को जगह नहीं दोगे तब तक न तो सामान वापस होगा और न ही पत्‍‌नी आएगी।
ससुर पर लगाया गंभीर आरोप
तलाशी में अनुज के पास पुलिस को जो प्रार्थना पत्र मिला, उसी के पीछे सुसाइड नोट लिखा है। इसमें ससुर पर जबरन अप्राकृतिक यौन संबंध बनाने का आरोप लगाया गया है। आरोप है कि ससुर इस बात पर ब्लैकमेल करने के साथ दुकान हड़पना चाहते थे।
दी थी मुकदमे की अर्जी
ससुराल वालों की प्रताड़ना से परेशान अनुज ने सीआरपीसी की धारा 156(3) के तहत पत्‍‌नी व ससुराल पक्ष के खिलाफ मुकदमे की अर्जी दी थी। इसमें फीलखाना पुलिस ने अपनी रिपोर्ट भी लगा दी है। अधिवक्ता शैलेंद्र चौरसिया के मुताबिक उन्होंने एक मुकदमा मीडिएशन सेंटर में भी दाखिल किया था। उधर, पत्नी के दहेज प्रार्थना पत्र पर मध्यस्थता एवं सुलह समझौता केंद्र में दोनों के बीच एक बार बात भी हो चुकी थी।

In recent times, some online forums had debated the need of a film that speaks about the misuse of IPC-498 A. The latest news is that a bilingual film on this subject is being made out of Kolkata. Titled "498A — The Misuse", the film will highlight the way some women in urban India are taking refuge in the law to harass men. The film will be made in Hindi and English and will be shot in Kolkata and Pune. Starring Romit Raj in the lead, the film also marks the non-Bengali language film debut of Kanchana Moitra and Moubani Sorcar.

Incidentally, the Supreme Court, reacting to a writ filed in 2005 (Sushilkumar Sharma v/s Union of India), had termed misuse of 498A as legal terrorism. It is this menace that director Sameer Sinha wants to highlight through the film.

While the laws were formulated to actually help oppressed women of rural India, today there is a large section of men who are harassed by the misuse of the laws by women in urban India. What does a man do if he is falsely implicated by 498A? What happens to a man if he is trapped in a bad marriage? While doing the research, I found that there are thousands of victims who have never been addressed. It's an academic subject and has hardly been addressed by anyone. Our film is about what a man or his family ought to do if he finds himself in such a situation," Sameer says.

Incidentally, the story is about a young couple (Romit and Sania Chaudhury) who fall in love. But once the marriage turns bitter , Romit wants to come out of the marriage . But Sania misuses 498A to trap Romit. The film is about how Romit tries to come out of the mess. "I wanted someone who is fresh but has worked in the industry. In this film, Moubani is playing Romit's saviour. While I had auditioned a lot of girls in Kolkata, it was only Moubani who fit the bill at the screen test. Sania, who is from Kolkata and is now working in Telugu film industry, plays Romit's wife. I liked Kanchana's work in "Bye Bye Bangkok" and, hence, cast her. Through the film, I want to tell the youth that it's good to know the person well before taking the plunge. Otherwise, the legal system is such that it might unnecessarily make one pay a heavy price for it." Says Kanchana, who plays a psychopath in the film, "Some of my friends from the film industry have been victims of the misuse of this law. I have seen how they've suffered silently. Since this film will convey a very serious message, I was more than eager to be a part of this venture. In the movie, I play a loner, who has a negative influence on her sister and helps her to legally plot against her brother-in-law . I am comfortable speaking Hindi and with a language coach on board, I see no problems doing this bilingual movie."

दिल्ली (ब्यूरो)। यदि आप अपनी पत्नी की चिकचिक और अन्य कारणों से परेशान हैं तो आप को यह खबर जरूर राहत देगी। जिसमें मुंबई की एक जिला अदालत ने एक ऐतिहासिक फैसला सुनाते हुए पत्नी को गुजारा भत्ता देने से इंकार कर दिया है। कोर्ट ने घरेलू हिंसा कानून के बढ़ते दुरुपयोग के तहत यह फैसला सुनाया है। सूत्रों के अनुसार, 28 अगस्त को अपने दिए गए फैसले में अपर सत्र न्यायाधीश एपी रघुवंशी ने माना कि घरेलू हिंसा अधिनियम, 2005 के तहत पत्नी किसी राहत की हकदार नहीं है। मुंबई में अनिल और राधा (परिवर्तित नाम) की 29 अप्रैल, 2002 को हिंदू रीति-रिवाज से शादी हुई थी। विवाह के 15 महीने बाद पति ने हिंदू विवाह अधिनियम, 1955 की धारा 13(1) के तहत क्रूरता के आधार पर बांद्रा में तलाक की याचिका दर्ज की। याचिका में अनिल ने अपनी पत्नी पर झगड़ा करने औऱ अशिष्ट व्यवहार करने का आरोप लगाया। अनिल का कहना था कि पत्नी के बुरे बर्ताव के कारण ही उनके संबंधों में दूरी आई। उसके बाद कोर्ट ने काउंसलरों ने इन दोनों को मनाने की कोशिश की। इस दौरान अनिल का पत्नी राधा ने माना कि वह पति के साथ बुरे व्यवहार करती है। हालांकि दोनों संबंध सुधार के तहत फिर अपनी गृहस्थी में जुट गए। लेकिन कुछ दिनों के बाद ही अनिल की पत्नी राधा ने उसके मायके से मिले सभी जेवरों को अपने कब्जे में लेकर गुजारे-भत्ते के लिए आवेदन करने के साथ घरेलू हिंसा अधिनियम के तहत शिकायत दर्ज करा दी। यही नहीं, उसने पति के खिलाफ थाने में भी मामला दर्ज करा दिया। उसने आरोप भी लगाया कि अनिल ने उसकी मां से डेढ़ लाख रुपये लिए हैं। इस पर मजिस्ट्रेट कोर्ट ने पत्नी और बच्चे को प्रति माह तीन हजार रुपये गुजारा-भत्ता बांध दिया। जरूर पढ़ें- पत्‍नी ने 18 साल की युवती से करायी अपने पति की शादी कोर्ट ने राधा की मां से लिए गए डेढ़ लाख रुपये भी लौटाने के आदेश दिए। इस आदेश को चुनौती देते हुए अनिल ने सत्र न्यायालय में गुहार लगाई। सत्र न्यायालय ने अनिल की याचिका स्वीकार कर ली। कोर्ट ने माना कि सुनवाई के दौरान पत्नी आरोपों को साबित करने में विफल रही। लिहाजा, वह राहत की हकदार नहीं है। डेढ़ लाख रुपये लौटाने के संबंध में कोर्ट ने कहा कि यह पति और पत्नी के माता-पिता के बीच का मामला है। इसके लिए सास-ससुर दीवानी का मुकदमा डाल सकते हैं।

Wife's unsubstantiated allegation of infidelity against hubby

Unsubstantiated allegations made by wife in a court of law during divorce proceedings about her husband's extramarital relations amounts to cruelty, the Bombay High Court has ruled, while allowing dissolution of marriage on these grounds.

The ruling was delivered recently by a bench which quashed a Pune family court order of July 11 dismissing a divorce petition filed by a man on the grounds of cruelty.

Hearing an appeal of husband against the impugned order, justices G S Patel and O S Oka allowed dissolution of marriage between Mahesh and Mohini Paigude.

The husband had filed a petition in the family court seeking a decree of divorce on the grounds of cruelty. One of the grounds pressed by him was an unsubstantiated allegation made by his wife that he was having extramarital relationship.

The High Court held that making such unsubstantiated allegations amounts to causing mental cruelty to the husband.

"Therefore, we have no manner of doubt that unsubstantiated allegations made by the respondent wife in paragraph 6 of the written statement amounts to assault on character and reputation of the Appellant and the same constitutes a mental cruelty which entitles the Appellant to claim a decree of divorce," the judges noted.

The High Court observed that the finding of this aspect has been recorded in paragraph 16 of the impugned judgment. "In fact, in paragraph 16, the learned family court Judge has accepted that there are baseless allegations in the written statement. However, the learned Judge has observed that the Appellant has no grievance about it."

"Perhaps the said finding is based on incorrect reading of the statement made by husband in cross-examination that he was demanding divorce mainly on two grounds (refusal of the Respondent to maintain sexual relationship with him and that she used to threaten that she would commit suicide if he had sexual relations with her)."

"The observation of the judge that the allegation in the statement is not torturous and, therefore, does not amount to cruelty, is completely erroneous," the bench noted.

"As we have already held, not only had the wife failed to substantiate allegation but in cross-examination, she has made it clear that she was entertaining a doubt about the character of appellant," the judges said.
