Police, on Friday, arrested a 23-year-old woman who allegedly drove Sriraj Subramanian, an IT professional, to suicide.
Gayatri alias Jennifer, a resident of KR Puram and working with a private bank’s tele-marketing department, trapped him in online romance by mailing him fake photos and false messages.
According to deputy commissioner of police (east) TG Krishna Bhat, Gayatri used to send him photos of her beautiful friend. She also mailed him false information about her job by claiming that she was working as an IT professional in a top firm. The girl had just passed 7th class.
Sriraj immediately fell in love with her. As the romance progressed, he was longing to meet her. Then came the shock when, one day, he received a mail saying that she was getting engaged with ‘David’ living in England.
He believed her and his world crashed. The love-sick youth had only one choice left.
He took some sleeping pills, got into the rear seat of his black Volkswagen, ran cell tape all over his legs, covered his head with a plastic bag and put on the seat belt to embrace death.
On Tuesday morning, people found his body in that posture at AECS Layout near Kundalahalli in the limits of Mahadevapura police station.
The police initially took it as a case of murder. But further investigation and the post-mortem report confirmed that he had committed suicide.
They soon traced the woman who had driven him to the extreme by checking his emails. The last e-mail, the longest he had ever sent, was around 2.37 am on Tuesday.
In it he told her how she should behave with her kids and husband in future. She should never to scream at her children. He also requested her to name her daughter as Kate and son as Jack.

Court acquits two in dowry death case as complainant-cum-witness turns hostile

A local court on Tuesday acquitted two persons charged with abetment to suicide, as the complainant-cum-witness turned hostile.
Pawan, accused in the case was married to Sunita, who died after jumping from the third floor of her house in Sector 15-C on March 25 this year. Pawan allegedly harassed his wife for dowry. Sunita's brother Rajesh, who is the complainant in the case, had alleged that Pawan and his father Nand Kishore harassed his sister for money, following which a case was registered under Section 306 (abetment to suicide) of Indian Penal Code against them.
According to the complainant, he got a call on March 25 around 4 pm from the accused and was informed that his sister has been injured and has been taken to PGI. Around 7 pm on the same day his brother got a call that Sunita has jumped from the third floor of her house.
Rajesh, in his initial complaint, had alleged that Pawan and Nand Kishore demanded cash and motorbike. He had also told the police that they spent around Rs 12 to 15 lakh in the marriage which took place in 2000.
According to Rajesh, Sunita, a mother of two children, was not given proper food and was not allowed to meet her children. She was also sent to her parents ancestral home after marriage for some time. He said a local panchayat at her parents home tried to resolve the issue on several occasions.
However, Rajesh later turned hostile and refused to accept that he made any statement before the police regarding the amount of money being spent on the marriage. He also denied that he made any statement about any panchayat being held to resolve the dispute.

Adultery is not cruelty, Supreme Court says

NEW DELHI: Merely being "intimate" with another woman is not sufficient ground for a man to be held guilty of inflicting cruelty on his wife on the charge of failing to discharge his marital obligations, the Supreme Court ruled on Monday.

Only if treatment meted out to the wife is of a nature as is likely to drive her to commit suicide will it fall within the ambit of Section 498A of IPC, a provision of the penal code providing up to three years in jail, said the bench.

"We are of the view that the mere fact that the husband has developed some intimacy with another, during the subsistence of marriage, and failed to discharge his marital obligations, as such would not amount to cruelty," said a bench of Justices K S Radhakrishnan and P C Ghose.

The SC reading of what constitutes cruelty brought relief to a man who had been convicted by both the trial court and the high court for behaviour that resulted in the suicide of his wife due to an alleged extra-marital affair at his place of work.

The ruling came in a case where the wife committed suicide suspecting the husband of intimacy with a woman colleague in office. The trial court and the Gujarat high court held him guilty under Section 498A for causing cruelty to his wife and under Section 306 of IPC for abetting suicide.

"Harassment, of course, need not be in the form of physical assault and even mental harassment also would come within the purview of Section 498A IPC. Mental cruelty, of course, varies from person to person, depending upon the intensity and the degree of endurance, some may meet with courage and some others suffer in silence, to some it may be unbearable and a weak person may think of ending one's life," the bench said.

But keeping in view the case before it, the apex court set aside the concurrent judgments to exonerate the man of any wrongdoing and said, "We, on facts, found that the alleged extra-marital relationship was not of such a nature as to drive the wife to commit suicide or that A-1 (husband) had ever intended or acted in such a manner which under normal circumstances, would drive the wife to commit suicide."

Writing the judgment for the bench, Justice Radhakrishnan said to charge a husband for abetment of suicide, the prosecution must establish that the wife's suicide was a direct result of the extra-marital affair.

"Prosecution has to establish beyond reasonable doubt that the deceased committed suicide and the accused abetted the commission of suicide. But for the alleged extra-marital relationship, which if proved, could be illegal and immoral, nothing has been brought out by the prosecution to show that the accused had provoked, incited or induced the wife to commit suicide," the court said.

"We have on facts found that, at best, the relationship of A-1 (the husband) and A-2 (the other woman) was a one-sided love affair. The accused might have developed some liking towards A-2, his colleague, (but) all the same, the facts disclose that A-1 had discharged his marital obligations towards the deceased. There is no evidence of physical or mental torture demanding dowry," the court said.

Referring to the wife's suicide note, the bench said, "On reading the suicide note, one can infer that the deceased was so possessive of her husband, and was always under emotional stress that she might lose her husband. A Naval officer, Lt. Francis S. D’Costa, posted at INS Kadamba in Karwar, committed suicide by hanging at his residence on Saturday. The officer was staying with his wife, two children and mother-in-law. He came to INS Kadamba 20 days ago from the Naval Detachment at Nagapattinam. The police have recovered a suicide note.

There is no help for a man if the wife is abusive. The judgment where the court granted divorce to a man who accused his wife of mental cruelty, citing her abusive behaviour towards him, his friends and his relatives needs to be supported. In a marital set-up, if a wife keeps on humiliating her husband for whatever reasons — financial or sexual incompetence — the man is bound to feel a loss of dignity and it is in no way different than the loss of dignity of a wife for any reason. We should see this in the same view of a man humiliating his wife by attacking her womanhood — when she is unable to bear a child — or even if he taunts her for her looks. As a progressive and just society, we should discourage any form of humiliation based upon gender roles. The Supreme Court has given many judgments in which it has granted divorce when the wife has been abusive towards her husband and insulted him in public. Today, men have no place to go to for help if they have an abusive wife or one who shows signs of compulsive obsessive disorder. Men do not even ask for help and continue to suffer in abusive relationships as it is considered unmanly to seek help. The real problem lies in the fact that society functions by creating competition among men. Unfortunately, in the patriarchal social mindset, a man has to earn his manhood to gain respect and survive. The emotions of a man are not respected in the same way as the emotions of a woman are. With the increasing focus on women’s issues, there is a lack of positive space for men in society. Many a time it is found that men turn violent towards themselves and take the extreme step. Every year, over 63,000 married men commit suicide in India. These men are mostly those who have proven their manhood and have become eligible for marriage, including many professionals. A 60-year-old man, tortured by his daughter-in-law, attempted suicide inside a police station in Delhi on Thursday when policemen cold-shouldered his complaint.
Rajbeer Singh consumed a poisonous substance inside west Delhi's Kanjhawala police station premises after police personnel did not pay heed to his complaint against his daughter-in-law.
Singh was rushed to a hospital where his condition was stated to be out of danger.
A police officer said Rajbeer had approached the police station a day ago and informed that his daughter-in-law had thrown him out of his house after usurping his property.
However, the policemen sent him home, telling him to come if his daughter-in-law did not mend her ways.
According to sources, Rajbeer arrived at the police station today (Thursday) but, once again, the policemen turned a deaf ear to his pleas. Frustrated, he then consumed the poisonous substance.

MUMBAI: The Bombay high court on Tuesday observed that a suicide note alone was not enough proof in a case of abetment of suicide and dismissed an appeal against acquittal in one case. In the absence of independent evidence to prove a case of abetment, Justice A H Joshi dismissed the appeal filed by the victim's family.

The judge was hearing an appeal filed by the family of a suicide victim against the acquittal. The appeal, filed last year by one Sunil Bhavsar, challenged a sessions court verdict of acquittal. His lawyer argued that it was a case in which a woman was pushed into committing suicide and that a suicide note she left behind "proved the abetment charge". She was harassed and threatened, the lawyer argued.

The case was from Nashik and the lawyer said a complaint was filed in 2010 with the Nashik police about the harassment and threats she faced that led to her eventual suicide. Hence, the abetment to suicide charge is proved, he argued and the acquittal ought to be overturned.

The state did not file an appeal. The appeal itself was dismissed, by default, by the HC earlier in March 2013 as the lawyer for the appellant had not turned up on a date when it was scheduled for a hearing.

On Tuesday, when the lawyer for the victim's family stressed on the suicide note and threats she allegedly received before the suicide, Justice Joshi said, "This is no mathematical equation, that a suicide note plus threat equals abetment...If harassment is proved, show the proof," the HC said. The judge said, "A threat to kill is not abetment. (Giving) An advice to kill is also not abetment."

In case of a suicide, higher courts have held that in each case the circumstances and evidence is crucial to decide whether there was abetment, which would involve acts by another person to actually instigate the person into committing suicide, the SC has held.

Businessman kills self, in-laws booked

GURGAON: A 35-year-old businessman committed suicide here after accusing his wife and her parents of harassing him, police said on Tuesday. Six people from his wife's family were charged with abetment to suicide.

Amit Garg, a resident of Mandi Govindgarh in Punjab's Fatehgarh Sahib district, took poison and died here on Monday.

The coal businessman, who got married in February this year, had come to Gurgaon to meet his maternal uncle.

"Amit consumed poison at his uncle's house in Kendriya Vihar. He was rushed to a hospital and died during treatment," police official Pradeep Singh told IANS.

"The deceased left a suicide note blaming his wife and her parents for his extreme step," Singh said.

Kanpur: A 20-year-old woman allegedly committed suicide after being threatened by her sister-in-law of implicating her in a case of dowry harassment, police said in Kanpur today.

The woman allegedly hanged self in her room yesterday, police said.

A suicide note has been recovered in which she has blamed her sister-in-law and her relatives for her suicide, police said.

The note alleged that the sister-in-law used to threaten the victim and other family members that she would implicate them in a dowry harassment case if they asked her to do household works, police said.

No arrest has been made so far and family members are being questioned, police said.

Ashok Yadav, resident of Yadav Colony, was seen hanging in his room today morning at 7.30 am by his mother who immediately informed other family members. The victim was rushed to the hospital but he was declared dead by the doctors.

Yogesh Yadav, brother of the deceased, has lodged a complaint against Ashok’s in-laws and his wife  for pressurizing Ashok for Rs. 5 Lac failing which, they would complain against him under Mahila Pratarna, said police.

Yogesh informed that, “My brother got married last year. On the very next day, his wife went back to her house at Nathdwara and never came back. Her family members often threatened Ashok for five lac rupees in cash for breaking the marriage.”

Yogesh also informed that the girl was already married to somebody else before getting married to his brother Ashok.

On the other hand, Ashok’s in-laws said that Ashok was not physically fit and they wanted their daughter to divorce him. “There was no issue of cash”, informed Navratam Yadav, Father-in-law of the deceased.

कानपुर, हमारे संवाददाता: ससुराल वालों की प्रताड़ना से पीड़ित युवक ने न्यायालय भवन की पांचवी मंजिल से कूदकर जान दे दी। तलाशी के दौरान जेब से मिले सुसाइड नोट में उसने इसका जिक्र किया है। ससुराल वालों के खिलाफ उसने एसएसपी से गुहार भी लगाई थी।
न्यायालय भवन में शनिवार अपराह्न डेढ़ बजे एक युवक के पांचवी मंजिल से छलांग लगाने के बाद हड़कंप मच गया। सूचना पर कचहरी चौकी इंचार्ज अखिलेश गौड़ मौके पर पहुंचे और युवक को उर्सला ले गए जहां डाक्टरों ने उसे मृत घोषित कर दिया। तलाशी के दौरान मृतक की जेब से एक प्रार्थना पत्र व एक समाचार पत्र का आईकार्ड मिला। प्रार्थना पत्र के पीछे मृतक ने सुसाइड नोट भी लिखा था। पुलिस ने प्रार्थना पत्र पर लिखे पते पर सूचना दी तो फीलखाना निवासी अमित गुप्ता ने मौके पर पहुंचकर मृतक की शिनाख्त छोटे भाई अनुज गुप्ता के रूप में की। अमित के मुताबिक अनुज कैनाल रोड स्थित अपनी दुकान में थे। पूर्वाह्न 11 बजे एक फोन आया जिसके बाद वह बिरहाना रोड जाने की बात कहकर चले गए। अपराह्न 1:30 बजे पुलिस ने घटना की जानकारी दी।

ससुराल वालों से था प्रताड़ित
बड़े भाई अमित के मुताबिक अनुज की शादी चार साल पहले इटावा बाजार की प्रगति संग इस शर्त पर हुई थी कि वह उसे लेकर परिवार से अलग रहेगा। प्रगति विदा होने के बाद ससुराल न आकर किराए के घर में रहने गई थी। परिवार से अलग रहने के कारण अनुज पर ससुराल वालों का दबाव था। वह अक्सर उसके साथ मारपीट करते थे। इस बात का जिक्र अनुज ने 22 जून को एसएसपी को दिए प्रार्थना पत्र में भी किया था। पत्र के मुताबिक 16 जून को उसकी गैर मौजूदगी में ससुर राम बिहारी, सास शीला, साढू़ प्रशांत कई लोगों के साथ घर आए थे। एक लाख नकद व सोने के गहनों के साथ पत्नी को लेकर चले गए थे। उसने ससुराल वालों से संपर्क किया तो उन्होंने जान से मारने की धमकी देते हुए कहा कि जब तक अपनी दुकान में साढ़ू को जगह नहीं दोगे तब तक न तो सामान वापस होगा और न ही पत्‍‌नी आएगी।
ससुर पर लगाया गंभीर आरोप
तलाशी में अनुज के पास पुलिस को जो प्रार्थना पत्र मिला, उसी के पीछे सुसाइड नोट लिखा है। इसमें ससुर पर जबरन अप्राकृतिक यौन संबंध बनाने का आरोप लगाया गया है। आरोप है कि ससुर इस बात पर ब्लैकमेल करने के साथ दुकान हड़पना चाहते थे।

ससुराल वालों की प्रताड़ना से परेशान अनुज ने सीआरपीसी की धारा 156(3) के तहत पत्‍‌नी व ससुराल पक्ष के खिलाफ मुकदमे की अर्जी दी थी। इसमें फीलखाना पुलिस ने अपनी रिपोर्ट भी लगा दी है। अधिवक्ता शैलेंद्र चौरसिया के मुताबिक उन्होंने एक मुकदमा मीडिएशन सेंटर में भी दाखिल किया था। उधर, पत्नी के दहेज प्रार्थना पत्र पर मध्यस्थता एवं सुलह समझौता केंद्र में दोनों के बीच एक बार बात भी हो चुकी थी।
