‘Step to protect men from wives’ fake complaints not enough’

Centre's directive to states say no arrests be made without proper investigation

Taking cognisance of the increasing number of false complaints being filed under section 498A of the Indian Penal Code (IPC), the Central Government recently issued directives to the state governments not to make any immediate arrests but conduct thorough investigations before taking any action. However, family court lawyers and activists feel that unless women are punished for lodging false complaints, this directive would not help.

"Though the directive is welcome, unless the women are punished by law for filing false cases under Section 498A, its misuse cannot be stopped," said Mahesh Kalge, a representative of Save Indian Family Foundation (SIFF), who runs a helpline for men in distress caused by domestic disputes.

Mahesh (name changed), an IT professional from Chinchwad, had to spent a week in the lock-up after his wife filed a harassment complaint with the police.

"In most cases, the investigating officer immediately arrests the husband, mother-in-law and sister-in-law, as per the statement given by the wife. However, when the allegations prove false, the investigating officer is never held at fault. It is time the judiciary take this into account," said Mahesh.

"This directive, if implemented strictly, will surely put a tab on the misuse of this section. Of the total cases filed under this section in one year, 85 per cent turn out to be bogus," said advocate Shailaja Kelkar, matrimonial counselor who practiced in the family court for 20 years. There should be a provision in the law where husbands can sue their wives for making false allegations. Women take to filing such false complaints with an eye on compensation or husband's property, Kelkar observed.

In a letter to state chief secretaries, the Ministry of Home Affairs has asked the state governments to issue directives to the police not to arrest the husband and his relatives without checking the genuineness of the anti-dowry complaint.

नौकरी से निकाला तो की मालिक के बेटे की हत्या

नौकरी से निकाले जाने से नाराज एक युवती ने दिल्ली में मंगलवार रात प्रॉपर्टी डीलर के बेटे की चाकू मारकर हत्या कर दी। युवती ने उसकी पत्नी पर भी हमला किया।

नाकाम होने के बाद उसने खुद को चाकू मारकर खुदकुशी का प्रयास किया। उसे जख्मी हालत में दीनदयाल उपाध्याय अस्पताल में भर्ती कराया गया, जहां उसकी हालत नाजुक बनी हुई है।

पुलिस के अनुसार, सुशील गुप्ता सपरिवार अंबिका विहार में रहता है। उसके परिवार में पत्नी अनिता, बेटी स्वाति और बेटा वरुण (25) था। सुशील सुंदर विहार में प्रॉपर्टी का काम करता है।

मंगलवार रात अनिता अपने बेटे के साथ घर में मौजूद थी। इसी दौरान उसके पति के कार्यालय में कंप्यूटर ऑपरेटर का काम करने वाली आशा (25) उसके घर पर आई।

आशा अनिता से नौकरी से निकाले जाने और वेतन के रुपए नहीं दिए जाने पर नाराजगी जता रही थी। अनिता ने कार्यालय की बात कार्यालय में पति से करने की बात कही और उसे काफी समझाया।

कुछ देर बाद अनिता उसके लिए चाय बनाने के लिए रसोई में चली गई। इसी दौरान बेटे वरुण की चीख सुनकर वह पीछे मुड़ी। उसने आशा के हाथ में चाकू था और पास ही वरुण लहूलुहान अवस्था में पेट पकड़कर बैठा हुआ था।

'पूरे परिवार को खत्म कर देगी'
आशा ने कहा कि वह आज पूरे परिवार को खत्म कर देगी और अनिता पर चाकू से हमला कर दिया। इसी दौरान स्वाति आ गई और उसने आशा को पकड़ने का प्रयास किया। पकड़े जाने की डर से आशा ने अपने पेट में चाकू से दो वार कर लिए।

सूचना पर सुशील घर पहुंचा और दोनों को अस्पताल में भर्ती कराया, जहां उपचार के दौरान वरुण की देर रात मौत हो गई। आशा की हालत नाजुक बनी हुई है। उसे निजी अस्पताल से दीनदयाल उपाध्याय अस्पताल रेफर कर दिया गया है।

पुलिस अनिता की शिकायत पर हत्या, हत्या का प्रयास और खुदकुशी के प्रयास का मामला दर्ज कर जांच कर रही है। आशा को दो दिन पहले ही सुशील ने काम से निकाल दिया था।

A 48-year-old woman allegedly bludgeoned her husband to death after she had a heated argument with him at their residence in the Rampuri area of Ghaziabad.
Police said Shanta Devi told them that her husband Sriram Sharma (54), a businessman, was an alcoholic and frequently fought with her and assaulted her. Shanta has been arrested for his murder.
Police said the couple lived with their daughter, who is an MBA student in Ghaziabad. On Tuesday, Sriram came home drunk and fought with his wife over a trivial matter, police said.
"The two had been having arguments for a while. Sriram had a transport business, which wasn't doing very well. As a result, the family's finances were suffering and it's possible that Sriram had taken to drinking because of this," Ranvijay Singh, Ghaziabad Deputy Superintendent Police, said.
Police said Sriram would often assault his wife while he was in an inebriated state. After her arrest, Shanta told police that the constant abuse — both physical and mental — had driven her to the murder.
Police said when the daughter saw her parents fighting, she tried to intervene and was told by her mother to go to the next room. "Following this, Shanta hit him on the head with a hammer. Death was almost instantaneous. After killing him, she covered him with a blanket and went off to sleep in the next room," Singh said.
Police said the body was discovered by the daughter on Friday morning, after which she informed the police.
This is the second such incident in National Capital Region in the last two days. On Thursday, an elderly woman was bludgeoned to death by unknown assailants inside her Malviya Nagar residence.

Lawyer felicitated for contribution in cause of men

ALLAHABAD: A High Court lawyer Arvind Kumar Pandey was felicitated by a section of lawyers for receiving an award at fifth National Men's Rights Conference held in Nagpur recently, for outstanding contribution in championing the cause of men in national and International arena, during a programme organized at Indian Coffee House on Saturday.

Addressing the lawyers, Arivind Kumar Pandey said, "Biased criminal laws have spoiled the lives of many men charged under the Dowry Act. The laws like Domestic Violence Act, IPC 498 a, and Maintenance Act, to name a few are heavily tilted in favour of women and have done more harm than producing good effects."

The Men's Rights National conference, held at Pench Tiger Reserve in Nagpur was attended by more than 150 men's rights activists, who represented 40,000 activists spread across India and other parts of the globe.

This year's national conference was held under the aegis of Nagpur Chapter of Save Indian Family Foundation (SIFF), now being run by Rajesh Vakharia. Few prominent International Men's Rights Associations like Marital Justice from United Kingdom and INSAAF from USA besides Men's Rights activists from Germany, Singapore, Japan, Australia, South Africa, Middle East, Japan and Russia also attended the conference.

Informing about the resolutions passed at fifth Men's Rights conference Arvind Kumar Pandey, who attended the conference as a writer and blogger said, "The first resolution was aimed at formation of Men's Welfare Ministry while the next resolution aimed at reducing the number of men involved in hazardous professions and another important resolution dealt with creation of gender-neutral treatment in legal aspects. Recognition of the rights of fathers, making shared parenting necessary in wake of separation was another major demand made on the occasion. The activists were unanimous in rejecting the highly biased Marriage Law Amendment Bill, 2010, and demanded its roll back. Lastly, the need to make huge investment in areas of Men's health was deeply felt."

The felicitation ceremony at Coffee House, Allahabad, was attended by advocates including Neeraj Shukla, Sampanna Kumar Srivastava, Ashish Nigam, Satyadhar Dubey, Arvind Kushwaha, Pintu Jaiswal, Shubhranshu Pandey, Arun Prakash Srivastava, Mohit Kesarwani and few others.

In 2011, when Ashish (name changed) landed a high-paying government job, his parents were on cloud nine. Little did they know what the future had in store for him: Hikes and promotions being denied because of a 40-year-old divorcee. A married man, Ashish initially could not understand why his boss would often invite him home for dinner, call him to her cabin or ask how she looked?
“It was when she started abusing me in public did I realise that she was angry as I had refused her overtures. She made my life miserable after that. I was loaded with work. And when the time came for hikes and promotions, I was given a bad rating. My hard work turned to dust,” he lamented. Talking to the H R department or other authorities yielded no results. “People would laugh at me. Men being harassed at work places is unheard of. Many presume that a man would actually enjoy it. I had to quit my job when all options were closed,” he adds.
The Ministry of Women and Child Development, in order to implement the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act 2013, which came into being in February, defined some finer details. These state that sexual harassment at a workplace may lead to termination of service of the accused, withholding of promotions and increments, and payment of reasonable compensation to the complainant. However, the Act only provides for aggrieved women, although the offense itself is gender neutral.
“The government is failing to recognise that sexual harassment is not a crime of passion, but a crime acted out to show dominance. In many cases, the aggressor may even be of the same sex,” explains Arnab Ganguly, a member of INSAAF (Indian Social Awareness and Activism Forum), an international NGO specialising in gender and social research, with branches in the United States and India. “The Act, however, does include a provision on “misuse” of the legislation, but it’s a very watered down version. The fine against people who misuse this Act is only `500 or 5 per cent of the aggressor’s salary, which doesn’t really act as a very serious deterrent to perpetrators,” informs Arnab.
The Save Indian Family Foundation along with INSAAF have tirelessly campaigned against the bill, so as to make it gender neutral. The fact that in India the definition of sexual assault incorporates men but the definition of sexual harassment refuses to consider men as victims seems preposterous, especially in the light of the research conducted by Synovate, a market research firm, across six Indian cities. The research states that in Bangalore alone, half of those who confessed to being sexually harassed at work had been harassed by women. Only 32 per cent said they were harassed by male colleagues.
“Although the new Act doesn’t provide for men as victims, most of the internal committees set up by companies to investigate sexual harassment are gender neutral. I usually sit in on many of these meetings as an external adviser and a lot of these cases have been filed by men as well. Companies now are being very open to issues faced by men at the workplace and take them very seriously,” says Kanti Joshi, an advocate who works with SASHA ( Support against Sexual Harassment), the consultancy arm of the NGO, IDEA (Integrated Developmental Education Academy) established to raise awareness and provide support services against sexual harassment.
Mohit Sharma (name changed), a senior architect who was working with a prominent design firm in the city, was fired unceremoniously because of allegations raised against him by a junior designer. “She wanted me to recommend her for a senior position when she clearly wasn’t ready. She flirted excessively and asked me to accompany her on coffee dates and when I didn’t comply she immediately complained to the HR, saying I was mistreating her and also alleged that I had made unwelcome advances towards her, when it was the other way around,” rues Mohit. His complaints simply echoed up the chain of command and were ignored in favour of the woman’s allegations, and after three months of fervent discussions back and forth, he was asked to leave the firm.
Atit Rajpara, president, Men’s Rights Association said that he gets more than 40 calls a month by men recalling horrifying incidents of sexual harassment at workplace.
Recalling a recent case, Rajpara said,” Shashi (name changed), an MNC employee was continuously harassed by his colleague, who wanted to marry him. When he stopped responding to her calls or messages, she landed at his doorstep and created a big scene.” Frustrated by this, Shashi filed a formal complaint with the HR. The woman was let off after a light warning but the harassment continued. She even blackmailed him that if he complained again, she would file a case against him for harassment. Despite repeated complaints, the woman continues to work with the company but Shashi was forced put in his papers. Rajpara added that in most cases men are mocked at when they talk about harassment. He said, “Sexual harassment should not be based on gender. It can happen to anyone, anytime. That’s why men never get justice.”
Women often misuse their rights and blame people at work places to get their way. In 2012, Shrishti Saxena used the same tactics. Being handed too much work by her boss, she decided to teach him a ‘lesson’. Instead of discussing the issue with him, she approached the HR and filed a sexual harassment complaint against him. Serious action was taken against the manager and Shrishti sighed a breath of relief.
Virag Dhulia, head of gender studies, Confidare India, a Bangalore-based research centre said that he gets more than three calls a month by men who have been harassed at work. “Gone are those days when offices were male dominated. These days a lot of women are handling top positions,” he said.
The centre has received calls on cases where women have tried to make advances towards their junior or colleague, asked them to stay back late at work,  threatened higher work burden and used lewd comments or abusive language. “The worst part is that companies don’t take these complaints seriously. The attitude is very insensitive towards men,” he said. Confidare runs a helpline, 9008302822, for those who are victims of sexual harassment.
