Parliament passes Companies Bill; Sachin Pilot terms it 'historic'

NEW DELHI: Parliament today approved the new Companies Bill that will make sweeping changes in the way firms operate and are regulated and replace a nearly six-decade-old legislation.

The new bill, which now needs the President's nod to become law, makes it mandatory for companies to spend on social welfare, empowers investors against frauds committed by promoters, encourages companies to have women directors, and seeks to bring in greater transparency in corporate governance matters such as executive salaries and the role of auditors.

Corporate Affairs Minister Sachin Pilot termed the passage of the legislation a "historic feat" and said it will give impetus to the country's growth momentum by ushering in a regime of "less regulations and more compliance."

The bill replaces the existing Companies Act, 1956, which has been amended at least 25 times in the past 57 years, with many of its provisions found to be outdated and inadequate.

The passage of the bill, which is spread across nearly 30 sections and over 300 pages, was widely welcomed by stakeholders, including industry bodies, political leaders and consultants.

"The focus of the bill is to enhance transparency and ensure fewer regulations, self-reporting and disclosure...It will outline the positivity in the economy," said Pilot, who has aggressively sought the support of lawmakers and other stakeholders for the bill since becoming Corporate Affairs Minister in October 2012.

The Bill was passed by the Lok Sabha more than seven months ago. Since then, its passage in the upper house has been delayed by disruptions in Parliament.

It has been almost three years since the submission of first report on the Companies Bill by the Parliamentary Standing Committee on Finance.

Pilot said that 96 per cent of the recommendations made by the Parliamentary Committee have been accepted and the Ministry would try to incorporate further suggestions by various stakeholders while formulating the final rules.

Among others, the new Bill provides about three dozen new definitions, including terms such as frauds, promoters, turnover, related parties (to promoters), small companies, associate companies and employee stock options.

It provides for a uniform financial year (April-March) for all companies, while the concept of one-person company has been introduced for the benefit of small entrepreneurs. Besides, the new Bill proposes strong checks against fraudulent money-collection activities through issuance of various securities.

The Bill requires auditors to be changed every five years to avoid collusion with the management, while rules would be tightened for appointment of independent directors.

To safeguard the interests of small investors, the Bill proposes approval by two-thirds of the public shareholders for deals that involve promoters and related entities.

It has a provision for setting up special courts for speedy trials and stronger steps for transparent corporate governance practices and curbing corporate misdoings.

The law also provides for "faster winding up" of firms as also for speedier clearances to businesses.

Participating in the Rajya Sabha debate, Congress leader Mani Shankar Aiyar asked Pilot to guard against bogus business entities.

Supporting the Bill, the BJP said a proper check needs to be there to ensure that unscrupulous people do not take advantage of the one-person company provision.

Industry bodies expressed their full support to the government for implementation of the Bill, with the CII saying its passage shows the "government's commitment to usher in a new era of corporate regulation."

Mumbai: The Bombay high court said on Thursday that an ‘affair gone bad’ cannot be the ground for accusing a man for rape. Justice Sadhna Jadhav acquitted Borivali resident Manesh Kotiyan of rape charges three years after his arrest.

Justice Jadhav said, “The very fact that the prosecution has admitted in the cross-examination that she had a love affair with the accused and she desired to marry him. In these circumstances, offence under Section 376 of the IPC (rape) would necessarily fail.” She ruled that the rape charges against Kotiyan were ‘unsustainable’.

While acquitting a rape accused Manesh Kotiyan, the HC noted, “She had not cried for help and had not taken her resistance to a logical end. Hence, it would not be justifiable to hold that the consent was obtained by intimidation, force meditated imposition, circumvention surprise or undue influence.” "The complainant is an educated adult person," said the judge. "She was fully aware of the fact that he (Kotiyan) was attracted to her. She chose to accompany him to Gorai. She also checked into a hotel to celebrate his birthday. She was aware of the consequences," said the judge.

However, the court upheld Kotiyan's conviction on charges of cheating as he did not disclose to the victim that he was married and had children. Lawyer, who was appointed to defend Kotiyan, Arfan Sait said there was no evidence that the accused raped her, adding that they had always intend to marry her.

It may be recalled that the victim girl, who was four months pregnant, lodged a case of rape against Kotiyan in March 2010. The two had met when they were working at a stationery shop in Borivli.

According to the prosecution, they had gone to Gorai to celebrate Kotiyan's birthday in November 2009, where he forced her into having sexual intercourse.

In 2012, a sessions court held Kotiyan guilty of rape and sentenced him to seven years rigorous imprisonment.

Pune: Upset over the latest amendments in the Hindu Marriage Act which virtually give wives a final say in divorce 
 
cases, Men’s Rights Association (MRA) on Saturday staged a protest against the legislation which they term as 'draconian'.
 
"The bill has a provision giving power to the courts to not grant a divorce unless the wife was paid adequate amount of 
 
money in the name of financial security of the woman. Such powers may result in harassment of men," MRA president Atit Rajpara said.
 
He also said the bill also provides special powers to wives to oppose the divorce if she was unhappy with the money she received from the husband under section IPC 498 (A), domestic violence act and several other maintenance laws.
 
According to the MRA, such clauses are outright anti-male and gender-biased and therefore men’s rights activists and organisations are opposing them. Rajpara said the mens’ rights organisations want the bill to be gender-neutral.

NAGPUR: Men's rights activists from all across the country are calling on the society to oppose the Marriage Laws (Amendment) Bill, 2010. Calling the proposed bill as an anti-male and anti-marriage entity, the men have opposed discussion of the bill in the ongoing monsoon session of Parliament as they feel not enough discussion have been done while formulating the bill. The activists insist that the bill, which gives divorced women an equal stake in the husband's ancestral property, will result in several damaging results, with men being scared of marrying. They also say that it gives the women an unfair advantage. The activists have even declared that not only will they not vote for any member of Parliament who votes in favour of the bill, they would also actively lobby against all such MPs.

"Most men do not marry until they are well settled in life and have a house of their own. For that, they toil day in and day out in order to eke out a living worthy to possess a property. And tomorrow, with the passage of this law, if a man tends to lose his hard-earned property, then men and their families would see no reason for marriage," said city-based men's right activist Rajesh Vakharia. He also said that such laws will only promote the concept of divorce and open the doors of unfair use of laws by women. "Such laws only feed fuel to the fire of gynophobia (fear of women) in the society. There are enough false cases and extortion faced by men under laws regarding domestic violence," said Vakharia. Activists have urged the government to pass the bill only after sufficient debate, discussion and deliberations, and take all stakeholders into confidence.

सोनल अब तक 50 मर्दों को हिलाकर रख चुकी है। शारदा अब तक एक-दो नहीं बल्कि पूरी 50 शादी कर चुकी है। बस अब इसे सोनल की बदकिस्मती कहिए या फिर अन्य मर्दो की खुशकिस्मती कि ये 51वीं शादी नहीं कर पाएगी।

RANCHI: An Odisha girl, who earlier claimed that she was raped near Hatia railway station on July 23 and also that she was a minor, admitted to have cooked up the story to secure compensation after her medical reports false revealed that she neither raped nor was she a minor.

A team of doctors headed by Dr Tulsi Mahto conducted bone age test on the girl at Rajendra Institute of Medical Sciences and reported that she was 19 years old and three months' pregnant.

Counsellor Seema Sharma, who was appointed by Jharkhand State Commission for Protection of Child Rights (JSCPCR) for examining her case, said the girl admitted that she was not raped and had falsely implicated one Pappu Kumar to make her claims look genuine. She said, "The girl revealed that she has been married for the last three years but her husband left her, few months ago. She is pregnant with the child of another man who lives in her neighbourhood. She also said that she lied under parental pressure."

Jagganthpur police station OC Anil Kumar said an FIR had been lodged in the case but when the medical reports arrived and it was found that the girl was lying, the case was closed. He said, "Initially, we lodged an FIR in the case but when JSCPCR and the hospital informed us that the girl is an adult and she was lying about being raped we closed the case"

Member of JSCPCR, Sanjay Mishra said false rape claims have become common, these days. "When we were investigating the Pakur case, where four school girls were gang-raped and compensation of Rs.1.20 lakh was awarded to all these girls, local residents told me that I will get to attend a rape case every day thereafter. No doubt the very next day two girls returned from Delhi claiming that they were raped which turned out to be a fake case again," he added.

Mishra further said it is the compensation money which forces girls to lodge false rape cases under pressure from their guardians. "Under the Schedule Caste and Schedule Tribe (prevention of atrocities) Act, 1989, there is provision of compensating a rape victim with Rs 1.20 lakh," said Mishra.

He added, "In all such cases, it was observed that the girl hailed from to a very poor family and her parents forced her to lie for compensation."

A 30 year old man hanged himself at his house today morning; his family blamed his wife and her family members for allegedly provoking him for committing suicide on the issue of five lac rupees.

Ashok Yadav, resident of Yadav Colony, was seen hanging in his room today morning at 7.30 am by his mother who immediately informed other family members. The victim was rushed to the hospital but he was declared dead by the doctors.

Yogesh Yadav, brother of the deceased, has lodged a complaint against Ashok’s in-laws and his wife  for pressurizing Ashok for Rs. 5 Lac failing which, they would complain against him under Mahila Pratarna, said police.

Yogesh informed that, “My brother got married last year. On the very next day, his wife went back to her house at Nathdwara and never came back. Her family members often threatened Ashok for five lac rupees in cash for breaking the marriage.”

Yogesh also informed that the girl was already married to somebody else before getting married to his brother Ashok.

On the other hand, Ashok’s in-laws said that Ashok was not physically fit and they wanted their daughter to divorce him. “There was no issue of cash”, informed Navratam Yadav, Father-in-law of the deceased.

Police has registered the case and started investigating it.

THIRUVANANTHAPURAM: At a time when governments are trying to provide more safety to women, a study report prepared by the Institute of Social Sciences, New Delhi, for the state police on various causes for crimes against women seems to be anti-women and regressive. The study cites economic independence of women, their response to crimes against them, dressing pattern, use of mobile phones by youngsters, boundaries of male-female relationships and ignorance on the part of women about their position as the causes, apart from some 50-odd disputable reasons.
The study collected data from 181 victims, 197 police officers, 40 social workers and 44 citizens with the sample size totalling to 462. The report 'Women Victims of Crimes in Kerala 2012-13' was prepared by Dr L Thara Bhai, a research coordinator of the institute. State police chief K S Balasubramanian received the report on Thursday. The office of the state police chief had taken up this initiative during 2012-13 with the help of the institute.

It is claimed in the submitted report that the prescriptive study to find causes also found solutions from public, social workers, police officers and victims themselves. The study gathered information regarding the victims' status after the crime was committed, their recovery and return to normalcy.
The study also found that crime against women is more visible among backward castes and SC/ST families, and 47.27% of the victims are from financially backward homes. "Income of the accused and crimes against women are correlated. Lesser the income, more the hatred towards the women in the family," stated the study that blamed poverty and alcoholism as the main causes for such crimes.

The study carried out by the prestigious institute for State Police cites economic independence of women, women responding to crimes against them, dressing pattern, use of mobile phones by young girls and boys, cutting boundaries of male- female relationships and unawareness from the part of women of their position, are the causes of growing crimes against women, apart from other 50-odd disputable reasons.
The report 'Women Victims of Crimes in Kerala 2012-13' was prepared by Dr L Thara Bhai, research coordinator of the institute. State police chief K S Balasubramanian received the study report at the police headquarters on Thursday. According to the report, the office of the Kerala State Police Chief took the initiative to conduct a study on women victims of crimes in the state during 2012-13 with the help of the institute.
It is claimed in the submitted report that the 'prescriptive study aimed to find causes and tried to find solutions either from the public, or from the social workers or from the police officers or from the victim themselves and 'gathered information regarding the victims' status after the crime was committed on them and the long process of coming back to normalcy'.
The study also finds that crime on women is more seen among the backward castes and SC/ST families. Majority (47.27%) of the victims have are financially backward homes. 'Income of the accused and the crime on women are correlated. Lesser the income more the hatred to the women in the family,' according to the study that finds poverty coupled with alcoholism as the root causes for crimes in the study.

Youth jumps from 5th floor of court buildin

KANPUR: A youth jumped from the fifth floor of the multi-storey building of Kanpur Nagar on Saturday. He was immediately rushed to the UHM Hospital where doctors pronounced him dead. He was later identified as Anuj Kumar Gupta.
A suicide note was recovered from the body, wherein Anuj had accused his wife and in-laws of harassment. In the suicide note, Anuj, who had a grocery shop at Canal Road, said that on June 16, his wife had shifted to her parents' house along with all valuables and cash worth Rs 1 lakh.

At that time, he was in his shop. After coming to know of the incident, he contacted his in-laws but was abused and threatened of dire consequences. The in-laws demanded that he provide a space in his shop for his brother-in-law to run a business.
Anuj further wrote that he had submitted a complaint with the police and a copy of it to the SSP. However, the police took no action. In the letter, Anuj also accused his father-in-law of physical exploitation.
On Saturday, Anuj had rushed to the court to meet his counsel after receiving a call.
However, after failing to locate the counsel, he climbed to the fifth floor and jumped from there. The police informed his elder brother Amit Gupta of the incident.
After reaching the court premises, Amit told police that Anuj was in his shop till 11 am. After receiving a call, he rushed to the Birhana Road. Amit also said that he repeatedly tried to contact Anuj but his mobile was switched off.

कानपुर, हमारे संवाददाता: ससुराल वालों की प्रताड़ना से पीड़ित युवक ने न्यायालय भवन की पांचवी मंजिल से कूदकर जान दे दी। तलाशी के दौरान जेब से मिले सुसाइड नोट में उसने इसका जिक्र किया है। ससुराल वालों के खिलाफ उसने एसएसपी से गुहार भी लगाई थी।
न्यायालय भवन में शनिवार अपराह्न डेढ़ बजे एक युवक के पांचवी मंजिल से छलांग लगाने के बाद हड़कंप मच गया। सूचना पर कचहरी चौकी इंचार्ज अखिलेश गौड़ मौके पर पहुंचे और युवक को उर्सला ले गए जहां डाक्टरों ने उसे मृत घोषित कर दिया। तलाशी के दौरान मृतक की जेब से एक प्रार्थना पत्र व एक समाचार पत्र का आईकार्ड मिला। प्रार्थना पत्र के पीछे मृतक ने सुसाइड नोट भी लिखा था। पुलिस ने प्रार्थना पत्र पर लिखे पते पर सूचना दी तो फीलखाना निवासी अमित गुप्ता ने मौके पर पहुंचकर मृतक की शिनाख्त छोटे भाई अनुज गुप्ता के रूप में की। अमित के मुताबिक अनुज कैनाल रोड स्थित अपनी दुकान में थे। पूर्वाह्न 11 बजे एक फोन आया जिसके बाद वह बिरहाना रोड जाने की बात कहकर चले गए। अपराह्न 1:30 बजे पुलिस ने घटना की जानकारी दी।

ससुराल वालों से था प्रताड़ित
बड़े भाई अमित के मुताबिक अनुज की शादी चार साल पहले इटावा बाजार की प्रगति संग इस शर्त पर हुई थी कि वह उसे लेकर परिवार से अलग रहेगा। प्रगति विदा होने के बाद ससुराल न आकर किराए के घर में रहने गई थी। परिवार से अलग रहने के कारण अनुज पर ससुराल वालों का दबाव था। वह अक्सर उसके साथ मारपीट करते थे। इस बात का जिक्र अनुज ने 22 जून को एसएसपी को दिए प्रार्थना पत्र में भी किया था। पत्र के मुताबिक 16 जून को उसकी गैर मौजूदगी में ससुर राम बिहारी, सास शीला, साढू़ प्रशांत कई लोगों के साथ घर आए थे। एक लाख नकद व सोने के गहनों के साथ पत्नी को लेकर चले गए थे। उसने ससुराल वालों से संपर्क किया तो उन्होंने जान से मारने की धमकी देते हुए कहा कि जब तक अपनी दुकान में साढ़ू को जगह नहीं दोगे तब तक न तो सामान वापस होगा और न ही पत्‍‌नी आएगी।
ससुर पर लगाया गंभीर आरोप
तलाशी में अनुज के पास पुलिस को जो प्रार्थना पत्र मिला, उसी के पीछे सुसाइड नोट लिखा है। इसमें ससुर पर जबरन अप्राकृतिक यौन संबंध बनाने का आरोप लगाया गया है। आरोप है कि ससुर इस बात पर ब्लैकमेल करने के साथ दुकान हड़पना चाहते थे।

Safe house for battered men

India’s first domestic violence shelter for men opens its doors in Bangalore. Here’s one harassed husband’s story from inside the shelter. Francis Steven Dokka reports

For three months, a barely-furnished two-bedroom apartment on Bannerghatta Main Road was "heaven" for Prithvi (31). The apartment is a good advert for 'bare and minimum'--bean bags and plastic chairs in the living room; mats and bedsheets for bedding and a kitchen that has nothing more than essentials --a fridge, gas stove, some plates and glasses, and filtered water cans. The place is bereft of anything that usually makes a cold house a warm home. But for many harassed husbands this has been 'heaven' when their own homes turned hellish. Welcome to India's first domestic violence shelter for men.
 
The shelter was started on April 19 this year by Confidare Consultancy, a Bangalore-based men’s rights organisation founded by techies Anil Kumar, Virag Dhulia, Pandurang Katti and Mithun Kumar. These names are well-known in India’s men’s rights movement. They have made representations before the Indian Parliament and the US Senate. The safe haven for men operates out of an apartment owned by one of the founders and is an offshoot of the Men's Rights Community Center run by Confidare in Koramangala. Anil says, “Actually, the defining moment to start the shelter came many years ago when we started helplines for men facing domestic violence. The domestic violence shelter was just a logical extension of the helplines. Abused men are often coached by us to leave the abusive spaces (their homes) and go to paying guest or shared accommodations. Sometimes, we temporarily accommodate these abused men in our own houses for a few days. Declaring a complete house as a domestic violence shelter became the next logical step. It is not natural for men to run away from homes if they face abuse, because somehow society considers it unmanly, if a man runs away. Please note, we do not advise men to file for divorce. We suggest that they move to some other location to get some peace and recover.”
 
 
How Prithvi landed in the shelter is part of a bigger marital story — similar to ones being played out across India. Prithvi, a native of Hyderabad, was working at an IT firm in Bangalore, when he married a BTech graduate from West Godavari district in Andhra Pradesh four years ago. Soon, their marriage hit rough weather. Prithvi says, “My wife was treating me like an ATM. She began to frequently make outrageous demands that I buy her jewellery, take her to restaurants and movies. She didn’t understand that a family cannot afford to splurge all the time. When I didn’t meet her demands, she began complaining to her parents.” 
 
“Before we tied the knot, she promised to work after marriage to meet family expenses as Bangalore is a costly city. But after marriage, she did a U-turn. She refused to work. She began to taunt me with 'Can’t you feed your wife? Do you want your wife to earn and feed you?' queries. She wanted to stay at home and enjoy life. Another major disagreement was having kids. I wanted to have children but she wanted to wait.” 
 
Last October, their marital problems reached boiling point. “Our arguments aggravated. She left me and went to her parents. I requested her to return many times but she declined. Finally, I went to her parents’ house to ask her to come home. She told me she would return only if I signed half of my property in her name or give her Rs 15 lakh as financial guarantee. I flatly rejected her conditions. She hit back by filing a criminal case against me under the Domestic Violence Act alleging that I had harassed her for dowry. In addition, she filed a case seeking maintenance from me. Both the cases were filed in AP just to harass me. She then mailed FIR copies to my employer and even sent a telegram to my work place to portray me as a criminal. Thanks to her, I lost my job. With cops chasing me and unemployed, I became depressed. I even thought of suicide. That’s when I got in touch with Confidare Consultancy and became its member.” 
 
Prithvi landed at the shelter in April with two bags of clothes, some books, and almost broke. “I was once making Rs 50,000 a month and lived in a good house in Indiranagar paying Rs 12,000 as rent. Now, I couldn’t afford to rent a place. I needed a place my wife could not trace because I had to protect myself. I was fortunate to find this sanctuary. Considering my financial condition, Confidare even waived the fee.” Confidare charges a person Rs 150 per day to stay at the shelter. Inmates must make their own arrangements for food. No deposit is taken. Pandurang Katti, care-taker of the shelter, says, “This facility operates on trust. Those wanting to stay here must be members for at least six months and should gain our trust.” Pandurang emphasises it is not a “paying guest” facility.
 
At Confidare, Prithvi was given legal advice, apprised of his rights as a man and coached how to defend himself in court. “I also received moral support there,” says Prithvi. The safe house can shelter four men at any given time. Katti says: “As of now, we are not equipped enough if men flood the place. That’s why we don’t want to publicise its address.We do not have the bandwidth to run it on a 24/7 basis.” 
 
How does Confidare ensure that it doesn’t end up accommodating at the shelter men who have committed crimes against women? Virag says, “We don’t judge anyone. The courts are there to judge who is innocent or guilty. We only support to those who approach us. Generally, men who have committed crimes do not approach us. Such people need not approach us.The center’s aim is to help provide men temporary stay so that they can stabilise themselves.”
 
At the shelter, Prithvi slowly began to pick up the pieces of his broken life. “When I came to the safe house, I was vulnerable and on the verge of losing my mind. However, at the shelter I got back peace of mind. I began to think of my future course of action and started looking for a job.” 
 
At the shelter Prithvi would wake up at 7 am, sweep the apartment and make breakfast. At 10 am, he would study law books for a couple of hours. He would then head out for lunch. Post lunch, he would either take a nap or go to an internet centre to apply for jobs. Evening, would again be study time followed by dinner and sleep. He quips, “It was good to get some sleep after many sleepless nights.” 
 
The routine changed when new inmates arrived. He would interact with them a lot and listen to their stories. “It helped to meet other men like me there. Some of their stories were way worse than mine.” During weekends, he used to volunteer at Confidare’s community centre in Koramangala and counsel other men.
 
The stay at the shelter was also a humbling experience for Prithvi. “I once lived very well. Here I was having lunch and dinner at roadside eateries. I was living on money given by my retired parents, relatives and friends.” 
 
Anil says, “So far, six guys have stayed in the shelter, while about 30 approached us to use the facility.” Anil is already thinking of what will follow the shelter. “As it is certain that a lot of men may not marry due to ever increasing complicated laws of marriage and the high costs involved, the next logical step is to create hostels and old age assisted-living facilities for such men, which can provide them some security at old age. All this is part of a budding global men's movement called MGTOW (Men Going Their Own Way), where men may not really seek committed female companionship or even children, but rather prefer a peaceful or even monk like existence enriching their lives.” 
 
Meanwhile, Prithvi’s job hunt has paid off. He moved out of the shelter last week after he was hired by an IT firm in a city in South India. He does not see any chance of reconciliation with his wife. He wants to fight out all the cases filed by his wife. He says, “My priority is to live peacefully and contribute something to society.” That’s a big change in a man who entered the domestic violence shelter three months ago contemplating suicide.

Community of confidants
Confidare Consultancy offers help for husbands physically or verbally abused, or facing threats from their wives or in-laws. Its clientele includes men facing police complaints and court cases related to marital issues. It offers members coaching and education to be peaceful and fight court cases effectively. Men seeking help from Confidare are required to become members by paying a fee – Rs 2,500 for six months and Rs 4,500 for one year. Membership is also open to NRIs. Confidare also runs a Men’s Rights Community Center in Koramangala. The center offers members access to basic law books, legal citations, reference material, and videos related to laws and men’s rights.Anil says, “Our support group meetings are like Alcoholics Anonymous meetings, where men feel peaceful and free in spite of abuse and threats they face.” At one point of time, a majority of Confidare’s members were techies. Virag says, “Now, we have members from all strata of the society because men are being abused irrespective of their position in society. BANGALORE: This technology hub is witnessing a sharp rise in cases of discord in live-in relationships. Most cases reported are those of people working in the software and BPO industries.

"The number of cases of break-up in live-in relationships was 30 during 2011-12. This rose to 42 between April 2012 and March 2013. With an average of six cases reported every month, the number is expected to double this year," says Rani Shetty, chief coordinator with Mahila Sahaya Vani, a family counselling centre attached to city police.

Most live-in couples are in the 25-35 age group. To get accommodation, they declare themselves a married couple. Counsellors say such relationships are for financial and social security. Things fall apart when the boy refuses to tie the knot.

But the marriage had not been solemnized as Keshava's parents refused to part with their property if he married Arundhati, says BS Saraswathi, senior counsellor.

To get a house on rent, live-in couples tell landlords they are married. "They live like husband and wife, but their relationship has no legal sanction. When there is a break-up, we refer it to police as a case of cheating," says Aparna Poonesh, a counsellor at the Sahaya Vani. "It's for social and financial security. Nearly 60% of the cases referred to us revolve around sex," says Shetty. Most cases brought to the Sahaya Vani are from the corporate world. "They get to know each other mostly through social media, and share the same language and culture. With their peer groups away, they have individual choices and freedom," she adds.

"Youngsters should be made aware of the problems of living together," says Shetty. "As the relationship doesn't have legal sanction, they need to be careful. Most cases brought to our notice are of women complaining that the men they had lived with refused to marry them."

Marriage dream shattered

Runa (name changed), 27, an employee of a software multinational in the US, was attracted to Bangalore while chatting online with Biswajit (name changed).

As the friendship grew, Biswajit, 30, invited her to the city and promised to find her a job. She quit her job and flew to Bangalore three years ago. After living at a paying guest accommodation for a while, she joined Biswajit, who had taken a house on rent declaring himself and Runa husband and wife.

Runa landed a job. Things went smoothly till Biswajit's parents starting asking him to get married.

One day, Biswajit suddenly disappeared. Runa learnt that he had gone to look for a bride.

On his return, they had an argument. Biswajit manhandled Runa, leading her to the Sahaya Vani. A case of cheating was registered after Biswajit refused, at the counselling sessions, to marry Runa.

Once having hoped the relationship would eventually lead to marriage, Runa is inconsolable today.

SURAT: A 30-year-old woman, mother of two children, eloped with a 16-year-old boy in Kalvada village of Valsad district around 10 days ago and returned as they had no money.

The woman took the teenager to Kalol and Ahmedabad along with her two kids. They stayed at these locations for 10 day and returned when they ran out of money.

According to reports, family of the minor boy contacted police since the boy was missing. However, the family came to know about a woman missing from neighbouring residence. Later, families of both the teenage boy and the woman started searching.

The woman had eloped with the boy with cash Rs 10,000. The boy returned home on Friday and described the entire incident to his parents. He informed his parents that he was in relationship with the woman since last few months.

The woman did not return home and went to her parent's residence along with her two children. She got married to a man, who works with Gundlav GIDC, around 10 years ago.

मुंबई। मुंबई में शुक्रवार को नशे में धुत टीवी एक्ट्रेस और मॉडल साक्षी पारिख ने अपनी कार से पांच लोगों को कुचल दिया। एक व्यक्ति की मौके पर ही मौत हो गई। चार अन्य को बोरवली वेस्ट के भगवती सरकारी अस्पताल में भर्ती कराया गया है।
 
पुलिस के मुताबिक साक्षी काफी तेज स्पीड में कार चला रही थीं और नियंत्रण खोने से उनकी कार डिवाइडर से जा टकराई। इसके बाद उन्होंने पहले एक मोटरसाइकिल और फिर ऑटोरिक्शा में टक्कर मारी। घटना वेस्ट कांदीवली स्थित महावीर नगर इलाके के लिंक रोड की है।

पुलिस ने आरोपी एक्ट्रेस साक्षी को हिरासत में लेकर मामले की जांच शुरू कर दी है। बताया जा रहा है कि दुर्घटना के वक्त साक्षी नशे में थीं। प्रत्यक्षदर्शियों के मुताबिक दुर्घटना के वक्त कार की स्पीड 100 के करीब थी। उसने कार से नियंत्रण खो दिया था।

साक्षी कार को तेजी से दौड़ाते हुए ला रही थी कि अचानक नियंत्रण खोने पर  कार चार फीट चौड़े और दो फीट ऊंचे डिवाइडर को तोड़ते हुए बाइक और ऑटो रिक्शा से जा टकराई। हादसे में बाइक सवार की मौके पर ही मौत हो गई। उसकी पहचान दिलीप कुमार सोनी के रूप में हुई है।
 
पुलिस ने किया मामला दर्ज
घायलों में से दो की पहचान अजहर अहमद सिद्दीकी और लोकेश यादव के रूप में हुई है। घटना में टीवी एक्ट्रेस भी गंभीर रूप से घायल हुई। उनको मामूली उपचार के बाद पुलिस ने हिरासत में ले लिया है। चारकोप पुलिस स्टेशन में उसके खिलाफ मामला दर्ज किया गया है।

गुड़गांव में एक बीबीए स्टूडेंट ने पंखे से लटक कर अपनी जान दे दी. यह लड़का फरीदाबाद के तिगांव का रहने वाला था. दिनेश पालीवाल का शव सड़ी-गली हालत में गुड़गांव के सेक्टर 40 इलाके में ग्रीनवुड सिटी के G-105 नम्बर मकान में मिला.

दिनेश गुड़गांव में करीब 15 दिन पहले ही आया था और मकान का पहला फ्लोर किराए पर लिया था. आस-पड़ोस के लोगों को जब इस फ्लोर से बदबू आने लगी तो लोगों ने पुलिस को सूचना दी. पुलिस ने मकान मालिक से पूछ कर दिनेश के परिजनों को फोन किया जिनके आने के बाद कमरे का दरवाजा तोड़ा गया. जब कमरा खोला गया तो कमरे में पंखे से दिनेश का शव सड़ी-गली हालत में लटका हुआ पड़ा था. शव की पहचान दिनेश के चाचा ने की. गुडगांव पुलिस के मुताबिक दिनेश ने सुसाइड नोट में दिनेश ने अपनी खुदकुशी के लिए एक लड़की (आशा यादव) और तीन कॉलेज के दोस्तों को जिम्मेदार ठहराया है.

सेक्टर 40 के एसएचओ जय प्रकाश ने बताया, ‘हमें सूचना मिली थी की ग्रीनवुड सिटी केक फ्लैट से बदबू आ रही है जिसके बाद हमने मौके पर जाकर फ्लैट के मालिक को बुलाया जिस से जानकारी मिली की दिनेश नाम का युवक इसमें किराए पर रहता है. हमने दिनेश के परिवार वालों को बुलाया और कमरे को खोल गया तो पंखे से लाश लटकी हुई थी मौके से एक सुसाइड नोट भी बरामद हुआ है जिसमे दिनेश ने अपनी मौत के लिए एक लड़की और अपने तीन दोस्तों को जिम्मेदार ठहराया है. हम मामला दर्ज कर जांच कर रहे हैं.’ दिनेश ने सुसाइड नोट में लिखा है कि लड़कियों से प्यार मत करना.

दिनेश पीलवाल की उम्र करीब 24 साल थी और घरवालों ने दिनेश की शादी करीब एक साल पहले कर दी थी. पुलिस के मुताबिक दिनेश 15 दिन पहले अपने परिजनों से ये कहकर गुड़गांव आ गया था कि उसकी गुड़गांव में नौकरी लग गई है.

गुड़गांव पुलिस ने इस मामले में चार लोगों के खिलाफ आईपीसी की धारा 306/34 के तहत आत्महत्या के लिए उकसाने का मामला दर्ज कर किया है. दिनेश के परिजनों के मुताबिक दिनेश आशा के प्यार किया करता था. दिनेश ने फरीदाबाद में मानव रचना इंस्टीट्यूट से बीबीए की पढ़ाई की थी.

गुड़गांव पुलिस के मुताबिक दिनेश का शव करीब तीन दिन पुराना है. शव को पोस्टमॉर्टम के लिए सिविल अस्पताल भिजवा दिया गया है जहां पर गुरुवार को पोस्टमॉर्टम किया जाएगा. दिनेश पिछले तीन दिनों से अपने परिजनों का फोन नहीं उठा रहा था. पुलिस ने अभी इस मामले में किसी की गिरफ्तारी नहीं की है.

City lawyers handling domestic and family disputes have welcomed a recent judgement by the Bombay High Court (HC) stating that women filing false rape cases should be prosecuted.

Mens organisations have said that this judgement will help create a gender neutral society and if properly executed will help to bring down the number of rape cases by 70 per cent. They allege that most rape cases are filed after relations break down after consensual sex.

Justice Sadhna Jadhav of the HC on Wednesday observed that women who file rape cases in a fit of rage to fix their partners and later withdraw complaints, should be prosecuted.

She remarked that of late several cases were coming before the HC in which victims filed complaints alleging rape and contending that they had entered relationships after being promised marriage.

In a relationship between consenting adults, sometimes such complaints are filed in the heat of moment and withdrawn later. This has be-come a trend and sends wrong signal to the society, the judge observed on Wednesday.

The court cautioned the police to be vigilant and hold an initial inquiry to find out whether a rape complaint was genuine before registering the case.

The judge was hearing an anticipatory bail plea by Divyesh Vala (35), who admitted that he was in a relationship with a 42-year-old central excise inspector. He pleaded that he was falsely implicated and the case was causing him harm and agony.

The two had met through a social networking site and came close to each other after joining an Art of Living course. The woman alleged that she was raped by Vala, who promised to marry her. However, he married another woman and she felt cheated. Hence, she filed a complaint of rape.

The judge granted anticipatory bail to Vala for the sum of Rs 15,000 and asked him to report to the police station every Sunday until the investigation was over. The judge said it was not inclined to send Vala in custody because no useful purposes would be served in doing so, except satisfying the victim’s vendetta.

Talking to Mirror senior lawyer Milind Pawar said, “Some 90 per cent cases get registered just to satisfy vendetta after break ups. Though such cases are registered it is hard to prove them medically.”

In some cases, the Supreme Court has directed that FIRs in rape cases should be filed immediately, since later on it is difficult to prove it medically Pawar said. “This judgement will certainly teach a lesson to those who use the law to settle their own scores.”

Criminal layer Vijay Pamnani said, “In such rape cases the investigation officer’s role is very important to understand whether rape was actually committed or not. In the said case, the victim being a 42 years old, educated and  working as a central excise inspector knew very well that such a relationship is illicit in Indian society. I believe the HC has passed perfect orders considering facts of the case.”

Atit Rajpara, founder president of the Men’s Rights Association (MRA), Pune said, “Figures of increasing rape cases are only because of such false cases. Some women misuse the law like in domestic violence related cases.

In a recent survey, it was revealed that in Pune over 74 per cent cases of rape are consensual. We welcome this judgement as it has shown sensitivity towards men.”

However, lawyer Shirish Gade has a different opinion. He said, “As a criminal lawyer I believe that if the HC passes such orders against rape victim, those who wish to rape a girl will propose marriage and rape them. Unfortunately, victims won’t come forward due to such orders.

Additionally, in our society girls keep quiet about these serious offences as they are scared of society and fear nobody will marry them thereafter.”

Observing that poor grades of a 11-year-old girl in school showed that her mother was not taking proper care of her education, a Delhi court has granted her custody to her father. Guardian Judge Rakesh Kumar also observed that the mother of the child did not have sufficient space to provide her privacy in her growing years.
"The child's report card reflects certain disturbing facts. (It) reveals that the child scored only 47.67 per cent with C2 grade. It also reveals she was not regular in school and was absent for 32 days in the first semester.
"In these circumstances, it is proved that the respondent (mother) is not taking care for giving education to the child," the court said, and told the mother to hand over the girl's custody to her father.

If a woman lodges a false complaint of rape, then she should be prosecuted, observed the Bombay high court on Wednesday while granting anticipatory bail to an Art of Living teacher accused of rape.

Justice Sadhana Jadhav said, “The police should be careful and distinguish between genuine cases and false complaints.”

The judge remarked that of late several cases were coming to the HC in which ‘victims’ had filed rape complaints and alleged that they had entered into relationships after being promised marriage.

“In a relationship between consenting adults, sometimes, such complaints are filed in the heat of the moment. This sends wrong signals to society,” observed justice Jadhav.

The judge said the police should conduct initial inquiry into the matter and decide whether it is a genuine complaint or not.

The court was hearing an anticipatory bail application filed by Divyesh Vala, 35. He had sought anticipatory bail saying he has been falsely implicated and the case is causing him severe harm and mental agony. The complaint was filed by a central excise inspector, 42, alleging Vala raped her on the pretext of marrying her.

According to additional public prosecutor, Anil Shitole, the victim, who is also a divorcee, had contacted Vala through a social networking website, where they became good friends. Vala later cut all ties with her and married another woman in May. Following this, she registered a complaint with the RAK Marg police station in June this year.

Justice Jadhav, while granting Vala anticipatory bail against a surety of Rs15,000, said that both of them are adults and the victim, in her complaint, never said that she had sexual relations with Vala because he promised to marry her.

The court observed that Vala cannot be sent to custody as it would not serve any fruitful purpose except satisfying the complainant’s vendetta.

Justice Jadhav has directed him to report to the RAK Marg police station on Sundays.

New Delhi, July 31: Women and Child Development Minister Renuka Chowdhury today strongly defended Human Resource Development Minister Arjun Singh, saying a dowry harassment case against the latter was 'misuse' of the anti-dowry law. ''I definitely object to the misue of the Act like this,'' Ms Chowdhury told reporters when asked for her reaction about FIR being registered against Mr Singh and five of his family members by Uttar Pradesh police under the Anti-Dowry Act on a complaint by Madhvendra Singh, father of Priyanka Singh whom his grandson Abhimanyu had married. She said such incidents would harm the interests of the people genuinely seeking protection under the anti-dowry law. Though asserting that the law would take its own Course in the case, Ms Chowdhury, however, said the Act was made to benefit the people who are harassed for dowry. ''Such misuse of the law would create problems for those women,'' she added. She pointed out that the Human Resource Development Minister has already clarified that he was not even present at the wedding. The Uttar Pradesh police has registered an FIR against Mr Singh, his wife Beena Singh, son Abhimanyu Singh, grandson Abhijeet Singh and three others on the direction of Additional Chief Judicial Magistrate, Chandausi. Madhvendra Singh has alleged that Priyanka's in-laws had been demanding a Mercedes car and a flat in Noida from him and his daughter was being tortured when their demand was not met. Mr Singh had yesterday distanced himself from the case asserting that he had nothing to do with the allegation of harassment of his grandson's wife for dowry. Meanwhile, the Uttar Pradesh Government has indicated that it would order a CBI inquiry into the allegations against the Union Minister and his family members.

It was supposed to be a short, uneventful ride on a Bangalore Metropolitan Transport Corporation (BMTC) Volvo bus for Swati Nigam, a techie, on Saturday. Instead it turned out to be a trip right to prison — all because she allegedly lost her temper over a very trivial issue.
 
Swati, a native of Uttar Pradesh who works for Accenture in the city, was on her way to Marathalli and had boarded a Volvo (Route No. 500D) near Echo Space on the Outer Ring Road in Sarjapur. According to the police, she asked the conductor C Manjaiah, for a ticket. Manjaiah asked her to pay Rs 25, but since the distance was barely 4km, Swati objected and demanded an explanation. Manjaiah explained to her that the fare was Rs 25 if she alighted after the Marathalli Bridge, but the fare was only Rs 15 if she got down before the bridge. He told her that the stage changes after the bridge and that there is an increase of Rs 10 in fare for every stage. 
 
Swati appeared satisfied with the explanation and told the conductor that she would alight before the bridge. She asked for a Rs 15 ticket and gave the conductor a Rs 100 note. BMTC conductors suffer from a perennial problem of lack of small change and Manjaiah appeared no different. Manjaiah told Swati he did not have change and asked her to get change while he attended to other passengers.
 
When Manjaiah returned after a trip around the bus, Swati still didn’t have change. Manjaiah told her to pay the minimum fare of Rs 10 and to get down at the next stop. This triggered an argument between the two. Swati refused to pay since she was, quite literally, being forced off the bus. The conductor retorted that she should not have boarded the bus if she didn’t have the exact fare. 
 
According to the police, Manjaiah then broke out into Kannada, and Swati, under the impression that he was abusing her, resorted to violence. She slapped the conductor, hitting him on his right ear and followed up by clawing him. The driver, realising an altercation had broken out, locked the doors and, on the advice of other passengers, drove to the nearest police station. 
 
At the HAL police station, statements of both parties were recorded as were the statements of four other passengers. The passengers blamed Swati for starting the row and accused her of bad behaviour. A case of assault and obstructing a government servant was registered against Swati. Manjaiah was sent for a medical examination which confirmed an injury to his ear and temporary loss of hearing. He also had suffered bruises from scratching. Swati was then taken to a magistrate's house who remanded her to 15 days judicial custody. 
 
A depressed and disconsolate Swati was taken to Parappana Agrahara Central prison. Jail authorities say she spent most of Saturday night and Sunday weeping and had refused to eat. 
 
“Passengers should cooperate with the bus crew,” said KM Auradkar, BMTC Volvo divisional controller. “Small issues like this need to be sorted out . We will conduct an in-house inquiry on this issue.''
 
A friend of Swati, who wished to remain anonymous, claimed Manjaiah’s conduct was wholly unjustified. “When the conductor said he had no change and Swati agreed to get down, the conductor should not have insisted on her paying the Rs 10 minimum fare,” the friend said. “If she had change, she would have paid Rs 15 and continued the journey. From where will she get change? The conductor and some commuters misbehaved with Swati and provoked her by making comments in Kannada. She too has been assaulted. Once she is out of jail, we will register a complaint against the conductor and the driver.''
 
Manjaiah, however, claims the allegations that he and the driver had assaulted Swati were untrue and an afterthought. “If she was assaulted on board, she should have stated it before the police or the magistrate,” Manjaiah said.

उत्तर प्रदेश के मुरादाबाद में एक नामी कालेज के छात्र-छात्रा के बीच दो साल तक लिव-इन रिलेशन रहा और जब शादी की बात आई तो विवाद शुरू हो गया। मामला थाने पहुंचा।

छात्रा ने अपने रूममेट के खिलाफ बलात्कार का मुकदमा दर्ज कराया है। मामले को निपटाने के लिए कालेज प्रशासन के लोग भी पहुंचे, लेकिन छात्रा टस से मस नहीं हुई। युवक को पुलिस ने हिरासत में ले लिया है।

मूल रूप से सुल्तानपुर जिले की रहने वाली एक युवती मुरादाबाद के एक शिक्षण संस्थान से एमएससी कर रही है। करीब दो साल पहले वह संस्थान के दूसरे कालेज में पढ़ने वाले एमसीए फाइनल इयर के छात्र अभिषेक पाल निवासी लखनऊ के संपर्क में आई।

दोनों एक दूसरे के करीब आए और फिर मिलन विहार कालोनी के एक घर में किराए का कमरा लेकर पति-पत्नी की तरह रहने लगे।

समाज की नजरों में भी दोनों खुद को पति और पत्नी बताने लगे। लेकिन कुछ दिन पहले दोनों में टकराव शुरू हो गया। छात्रा शादी की जिद करने लगी तो छात्र ने इंकार कर दिया।

इसके बाद छात्रा ने शादी का झांसा देकर अपने साथ बलात्कार का आरोप लगाते हुए मझोला थाने में तहरीर दी। पुलिस ने छात्र को हिरासत में ले लिया।

सूचना पर संस्थान के अधिकारी भी थाने पहुंचे और समझाने का प्रयास किया, लेकिन युवती नहीं मानी। परिजनों ने भी समझाने की कोशिश की। समझौता नहीं होने पर पुलिस ने छात्रा का मेडिकल कराने की तैयारी शुरू कर दी। एसओ मझोला ने बताया कि आरोपी को हिरासत में लिया गया है। जांच की जा रही है।

मध्यप्रदेश के इंदौर शहर में एक अजीब सा मामला सामने आया जहां 18 साल की लड़की ने जिला कोर्ट में कहा कि उसकी शादी उसके दुष्कर्म के आरोपी से ही करा दी जाए।

लड़की का कहना था कि उसके मां-बाप एक अधेड़ से उसकी शादी करवा रहे हैं इससे बेहतर है कि मैं अपने दुष्कर्मी से शादी कर लूं।

इंदौर में गौरी नगर की 18 वर्षीय युवती मंगलवार को कोर्ट आई। एक वकील की मदद से फोन कर उसने अपने दुष्कर्म के आरोपी भगवान करण सिंह को बुलाया।

जब वह वहां पहुंचा तो लड़की ने पूरी बात बताई और उससे कहा कि मुझसे शादी कर लो। जब भगवान ने शादी की बात सुनी तो उसने हां कर दी।

भगवान का कहना है कि भले ही मुझ पर दुष्कर्म का आरोप लगा है लेकिन मैं इसे अपनी प्रेमिका मानता हूं। और इस तरह दोनों शादी के लिए राजी हो गए।

भगवान सिंह पर फरवरी 2013 में दुष्कर्म का आरोप लगा था। मामला कोर्ट में विचाराधीन है और भगवान को जमानत पर रिहा कर दिया है। मामले में पेच यह है कि अब शादी करते वक्त लड़की का कहना यह है कि उसने मां-बाप के दबाव में आकर यह आरोप लगाया था।

BANGALORE: A 64-year-old man clubbed his wife to death with a stick used to prepare ragi balls and then hanged himself in their residence near Mahalakshmi Layout on Tuesday morning. She was a private financier and entrepreneur and the couple often fought over her chit fund dealings and brusque way of recovering money.

Preliminary investigation revealed that a heated argument broke out between D Nanjappa Dasappa and Shashikala in the morning and he hit her on the head. "Shashikala, in her fifties, sustained serious skull injuries and died on the spot. Nanjappa panicked and hanged himself," deputy commissioner of police (North) Sandeep Patil said.

The couple is survived by son Manjunath and two married daughters, Devika and Dhanalakshmi.

Moolah rage?

Nanjappa Dasappa didn't like his wife Shashikala doing the money-lending business. And Shashikala allegedly taunted her husband that the family was prosperous, thanks to her business.

Nanjappa is a former ITI employee. Close relatives told police that Nanjappa didn't like his wife being in the money-lending business. He was upset about the way she recovered money from debtors and chit fund deals with women in the neighbourhood and said it was unbecoming of their family. Shashikala also allegedly taunted her husband on how her business had made the family prosperous and he did not contribute anything, police were told.

Devika was in tears when she recalled her father's phone call around 10.30am. "His trembling voice told me something was wrong and I rushed home to the tragedy," she said. Manjunath and his younger sister, Dhanalakshmi, shocked by the events, refused to say anything.

Sugandhini Malatesh, their neighbour in Srikanteshwaranagar, said the old couple fought often but the clashes never reached this level. "They lived on the first floor and rented out the ground floor," she said.

According to Manjunath's wife Pavithra, her in-laws had asked her to visit her mother's home in Peenya in the morning. "They were arguing and after my husband left around 8am, I took my three-year-old son to my parents' house. I came to know about the tragedy only when my husband called me about it," she said.

The last words

Minutes before ending his life, Nanjappa called Devika, who works with a private hospital in Malleswaram. "I have kept all the gold inside a bag and you take it all. I may not call you again ever," he said, before ending the call.
Devika thought her father may have been miffed after one of his usual scraps with her mother and rushed home to check if all was well. When she reached the house around 11am, she saw the main door slightly open. She was shocked to find her mother lying dead in the hall and father hanging from the ceiling fan in the bedroom.

There was blood splattered all over the hall and the ragi ball stick too had blood stains.

The high court on Thursday observed that some women were abusing IPC Section 498A to harass those the clause aims to protect them from — husbands and in-laws.
Justice K.S. Ahluwalia made the observation while quashing criminal charges against Mita Bhaduri and her husband Tapan, who were fearing arrest in connection with a case under section 498A (cruelty by husband or relatives of husband) lodged by her sister-in-law Maumita Maitra.
“The proceedings against the petitioners (Mita and Tapan) will be an abuse of the process of law. The FIR, along with all proceedings against the petitioners, is quashed,” Justice Ahluwalia said in his three-page order.
Quoting a Supreme Court ruling, Justice Ahluwalia said: “The ultimate object of justice is to find out the truth and punish the guilty and protect the innocent. The tendency of implicating all immediate relations is also not uncommon. The courts have to be extremely careful and cautious while dealing with these complaints and must take pragmatic matrimonial cases.”
Legal experts in the city welcomed Justice Ahluwalia’s view, which they said had highlighted the tendency of a section of women and their family members to misuse article 498A and lodge false complaints against in-laws.
“If a woman lodges a complaint of torture against her husband or any of her in-laws within seven years of marriage, police will have to arrest the accused first. No investigation is needed to arrest the accused or family members. Many women misuse the law to falsely implicate their husbands and in-laws,” said lawyer and former mayor Bikash Ranjan Bhattacharyya.
Maumita, a resident of Khardah, on the northern fringes of the city, had married Atanu in December 2002. The couple, who had been living at Atanu’s house in Sodepur, have two daughters — Arunima, 7, and Archisha, 5.
In December 2012, Maumita had lodged a complaint of torture against her husband, sister-in-law Mita and her husband Tapan.
Mita and Tapan — the couple got married in 1983 — live at Sinthee, around 12km from Atanu’s house. They moved a petition in the high court, seeking quashing of the proceedings against them.
The couple’s lawyer Debabrata Chatterjee submitted: “Maumita had complained that she had been regularly subjected to mental and physical torture by my clients. Is it possible? Mita and her husband have their own family. Why will they go to Sodepur regularly and torture Maumita?”
The judge observed: “It’s a fact that Mita and Tapan lived far way from the complainant’s house. The sister, who got married 19 years before her brother’s wedding, had nothing to do with the brother’s matrimonial affairs.”

In recent times, some online forums had debated the need of a film that speaks about the misuse of IPC-498 A. The latest news is that a bilingual film on this subject is being made out of Kolkata. Titled "498A — The Misuse", the film will highlight the way some women in urban India are taking refuge in the law to harass men. The film will be made in Hindi and English and will be shot in Kolkata and Pune. Starring Romit Raj in the lead, the film also marks the non-Bengali language film debut of Kanchana Moitra and Moubani Sorcar.

Incidentally, the Supreme Court, reacting to a writ filed in 2005 (Sushilkumar Sharma v/s Union of India), had termed misuse of 498A as legal terrorism. It is this menace that director Sameer Sinha wants to highlight through the film.

While the laws were formulated to actually help oppressed women of rural India, today there is a large section of men who are harassed by the misuse of the laws by women in urban India. What does a man do if he is falsely implicated by 498A? What happens to a man if he is trapped in a bad marriage? While doing the research, I found that there are thousands of victims who have never been addressed. It's an academic subject and has hardly been addressed by anyone. Our film is about what a man or his family ought to do if he finds himself in such a situation," Sameer says.

Incidentally, the story is about a young couple (Romit and Sania Chaudhury) who fall in love. But once the marriage turns bitter , Romit wants to come out of the marriage . But Sania misuses 498A to trap Romit. The film is about how Romit tries to come out of the mess. "I wanted someone who is fresh but has worked in the industry. In this film, Moubani is playing Romit's saviour. While I had auditioned a lot of girls in Kolkata, it was only Moubani who fit the bill at the screen test. Sania, who is from Kolkata and is now working in Telugu film industry, plays Romit's wife. I liked Kanchana's work in "Bye Bye Bangkok" and, hence, cast her. Through the film, I want to tell the youth that it's good to know the person well before taking the plunge. Otherwise, the legal system is such that it might unnecessarily make one pay a heavy price for it." Says Kanchana, who plays a psychopath in the film, "Some of my friends from the film industry have been victims of the misuse of this law. I have seen how they've suffered silently. Since this film will convey a very serious message, I was more than eager to be a part of this venture. In the movie, I play a loner, who has a negative influence on her sister and helps her to legally plot against her brother-in-law . I am comfortable speaking Hindi and with a language coach on board, I see no problems doing this bilingual movie."

Shooting for the film will begin in Kolkata on April 17.

दिल्ली (ब्यूरो)। यदि आप अपनी पत्नी की चिकचिक और अन्य कारणों से परेशान हैं तो आप को यह खबर जरूर राहत देगी। जिसमें मुंबई की एक जिला अदालत ने एक ऐतिहासिक फैसला सुनाते हुए पत्नी को गुजारा भत्ता देने से इंकार कर दिया है। कोर्ट ने घरेलू हिंसा कानून के बढ़ते दुरुपयोग के तहत यह फैसला सुनाया है। सूत्रों के अनुसार, 28 अगस्त को अपने दिए गए फैसले में अपर सत्र न्यायाधीश एपी रघुवंशी ने माना कि घरेलू हिंसा अधिनियम, 2005 के तहत पत्नी किसी राहत की हकदार नहीं है। मुंबई में अनिल और राधा (परिवर्तित नाम) की 29 अप्रैल, 2002 को हिंदू रीति-रिवाज से शादी हुई थी। विवाह के 15 महीने बाद पति ने हिंदू विवाह अधिनियम, 1955 की धारा 13(1) के तहत क्रूरता के आधार पर बांद्रा में तलाक की याचिका दर्ज की। याचिका में अनिल ने अपनी पत्नी पर झगड़ा करने औऱ अशिष्ट व्यवहार करने का आरोप लगाया। अनिल का कहना था कि पत्नी के बुरे बर्ताव के कारण ही उनके संबंधों में दूरी आई। उसके बाद कोर्ट ने काउंसलरों ने इन दोनों को मनाने की कोशिश की। इस दौरान अनिल का पत्नी राधा ने माना कि वह पति के साथ बुरे व्यवहार करती है। हालांकि दोनों संबंध सुधार के तहत फिर अपनी गृहस्थी में जुट गए। लेकिन कुछ दिनों के बाद ही अनिल की पत्नी राधा ने उसके मायके से मिले सभी जेवरों को अपने कब्जे में लेकर गुजारे-भत्ते के लिए आवेदन करने के साथ घरेलू हिंसा अधिनियम के तहत शिकायत दर्ज करा दी। यही नहीं, उसने पति के खिलाफ थाने में भी मामला दर्ज करा दिया। उसने आरोप भी लगाया कि अनिल ने उसकी मां से डेढ़ लाख रुपये लिए हैं। इस पर मजिस्ट्रेट कोर्ट ने पत्नी और बच्चे को प्रति माह तीन हजार रुपये गुजारा-भत्ता बांध दिया। जरूर पढ़ें- पत्‍नी ने 18 साल की युवती से करायी अपने पति की शादी कोर्ट ने राधा की मां से लिए गए डेढ़ लाख रुपये भी लौटाने के आदेश दिए। इस आदेश को चुनौती देते हुए अनिल ने सत्र न्यायालय में गुहार लगाई। सत्र न्यायालय ने अनिल की याचिका स्वीकार कर ली। कोर्ट ने माना कि सुनवाई के दौरान पत्नी आरोपों को साबित करने में विफल रही। लिहाजा, वह राहत की हकदार नहीं है। डेढ़ लाख रुपये लौटाने के संबंध में कोर्ट ने कहा कि यह पति और पत्नी के माता-पिता के बीच का मामला है। इसके लिए सास-ससुर दीवानी का मुकदमा डाल सकते हैं।
