Less conviction of rape accused raises concerns

Less conviction of rape accused raises concerns

MYSORE: Here is why there is low conviction rate in rape cases and why trial is delayed: in majority of the cases, the victims are influenced by police and family members.

Police officers mediate and make the victim either strike a compromise with the accused, or try to marry them off to the latter. "This weakens the case, because of many rape accused escape from punishment. In many cases, the trial is delayed," said a lawyer, who deals with such cases.

There has been less than 5% conviction in rape cases. Of the 2,798 cases reported between 2008 and 2012 in the state, only 123 accused have been convicted. In Bangalore, the conviction rate stands at 3.77%, while it is 11.1% in Mangalore city and nil in Mysore city. These figures were obtained from state police data under RTI by M L Parashuram of Mysore-based Odanadi Seva Samsthe, an NGO working for the welfare of women in distress.

The reasons for low percentage of conviction are different. In many cases, the victims lose their fighting spirit due to non-cooperation from the authorities concerned, humiliation and pressure from family members.

Speaking to TOI, advocate M N Sumana, a women activist, said: "Conviction is possible if the victims are strong-willed. If not, they either strike a compromise with the accused, or lose their courage in fighting the case."

N Vijay, deputy director of women and child welfare department, admitted that victims, on occasions, do compromise fearing social stigma. "Even their family members turn docile over a period of time, and fail to fight against injustice," he added.

The accused also go unpunished for various reasons, and victims do not have the capacity to approach higher courts. Financial constraints and their inaccessibility to the seats of judgment are some of the reasons for their failure to seek revision of judgment delivered by lower courts.

Odanadi director M L Parashuram claims that most of the victims are poor women, who don't have social support.

Accused of molestation by daughter-in-law, man commits suicide, blames her

Accused of molestation by daughter-in-law, man commits suicide, blames her

NAGPUR: A senior citizen, who had been booked for outraging the modesty of his daughter-in-law, committed suicide by consuming poison. Gajendra Malviya was declared dead on Wednesday at a private hospital. In his suicide note, he blamed the daughter-in-law and her relatives for the drastic step that he had taken.
The 65-year-old Malviya was out on an ad-interim bail after being made an accused in the molestation case. After that he returned to his house and continued to stay with the daughter-in-law.

The molestation complaint was filed on May 2 at the Kalamna police station. She had stated that Malviya had been making undue advances towards her in husband's absence.
Police said that the woman got married to Malviya's son in 2010. Due to alleged harassment by Malviya, she left soon after and returned to her parent's house in Paratwada (Amravati). Last year, she returned to Nagpur on being persuaded by the Malviyas. According to her, Malviya did not improve his behaviour which prompted the woman to lodge a police complaint.
A few days ago, the daughter-in-law was again set to lodge an FIR against Malviya and, his wife and son for harassment.
An upset Malviya then consumed poison on Wednesday and was rushed to a private hospital in Wardhaman Nagar where he was declared dead. Police said that Malviya had indicted his daughter-in-law and two of her close relatives for trying to implicate him and his family in more cases.
Senior inspector Sampat Chavan of Kalamna police station said that the suicide note is with the cops. "At present the matter is under investigation. No decision on registering an offence has been taken," he said.

Haryana youth offers to sell organs to pay off wife

Haryana youth offers to sell organs to pay off wife

KOLKATA, 6 JUNE: A youth from Haryana wrote to the President of India seeking his approval to sell his organs to pay his wife who had allegedly filed a "false" dowry case against him. The matter is now under consideration of the National Human Rights Commission.
Mr Sunil Kumar (in sns photo), a resident of Fatehgarh in Haryana, married on 26 June in 2009. A year after his marriage, his wife brought dowry harassment charges against him and asked him to pay maintenance.
According to Sunil, his wife brought "false" charges against him for monetary gain. Though he collected proof against the false claims through RTI application, it was ignored by the local court, he alleged in his letter to the President.
Sunil wrote the letter in May this year to the President explaining his financial constraints and how he is overburdened with loans. He said in his letter that since he is unemployed and has nothing to sell to pay the maintenance to his wife, he would like to sell his organs.
"Please permit mercy killing (euthanasia) for me and sell my body parts and organs so that my wife receives her maintenance," he wrote. The matter is now before the National Human Rights Commission.
Talking to The Statesman from Haryana, Sunil said that after his wife filed "false" dowry case against him in 2010 she "continuously blackmailed me to pay her Rs 10 lakh to settle the matter." Expressing his poor financial condition he surrendered to the police on 9 August 2010 and spend two days in judicial custody.
"But that was the beginning of our suffering. The judge even after knowing my mother's poor health sent her to judicial custody for four days. My mother who was discharged from hospital after a major tumour operation suffered paralysis after spending four days in Hawalati ward without medicine, food and proper care," Sunil said.
He said that in spite of bringing the facts with relevant proofs before the court, the judge did not consider them. "I even submitted evidence against the false charges collected through RTI Act. But even after her false claims without any evidence she got order in her favour," Sunil said. "But now I hope justice will be given as the matter is taken up by the NHRC. Otherwise, I don't have any option other than selling my organs to pay my wife," he added.
Mr Amarty Talukdar  of Save Indian Family Foundation (SIFF), said that extortion of money by abusing the dowry law is now rampant in India. "We are daily flooded with complaints from husbands who are falsely charged by their wives often to get financial advantage. The government should act now to stop its misuse," he added.

‘Take action against my wife’s family too. They paid me dowry’

‘Take action against my wife’s family too. They paid me dowry’

A hardware engineer was jailed following a dowry harassment charge in Sept 2010. Using the complaint as evidence, he has now filed a police case against wife and in-laws, seeking that they be punished for the offence of paying dowry

Manjunathan Padmanabhan, a hardware engineer, spent three harrowing days in Parappana Agrahara, sharing cell space with thieves and murderers. His crime? Accepting dowry. Now, in perhaps a first-of-its-kind case, the 34-year- has turned the tables on his wife and her family by filing a counter complaint for giving him dowry.

The Dowry Prohibition (DP) Act states that both giving and accepting dowry is an offence punishable by law, and Section 3 of the Act speaks about the “penalty for giving or taking dowry”. But while cases of husbands and their family members spending time in jail for receiving dowry are dime a dozen, rarely — if ever — has a dowry giver been punished.

In his complaint against his wife and in-laws, Padmanabhan, a resident of Ulsoor, has used the same statements made by his wife's relatives in their complaint against him three years ago. Ulsoor police registered an FIR on April 17.

In his complaint, Padmanabhan states that he was married to R Ashwini on September 2, 2009. His wife had filed a complaint against him on September 8, 2010 stating that she was harassed for dowry and that Padmanabhan was paid 119.75 grams of gold, 11 pieces of silverware and cash of Rs 25,000, Rs 1,000 and Rs 10,000 on January 2, 2010, July 5, 2010 and July 20, 2010 respectively. A case was filed against him under 498(A) of the IPC and under Sections 3 and 4 of the Dowry Prohibition Act.

In her complaint, Ashwini claimed that she and her family had also given Padmanabhan a suit in dowry. Her brother's statement claimed they had given cash on three occasions. The complaint was filed in the same police station (Ulsoor) and the complaint and the memo of evidence given by his in-laws are part of the station records. He claims he obtained all the necessary documents from the station through the Right to Information Act.

Padmanabhan is now seeking action against all family members who admitted to giving him dowry. “Since offenders and abettors themselves admitted/claimed to have given dowry, it is submitted further that all these records and details are already with you,” Padmanabhan has stated in his complaint.

Speaking to Bangalore Mirror, Padmanabhan said, “My father-in-law is a Central government employee. He knows giving dowry is a crime. He, along with his family, has admitted to giving me dowry. That is the crux of their complaint and police statements against me. They have admitted to committing a crime before a police officer and the police have to take action against those persons. I am only stating what the law says.”

When contacted for his reaction, Ashwini's father, A Ramesh Babu, the main accused in Padmanabhan’s complaint, said, “I have not paid any dowry to him. Only a complaint of harassment for dowry was filed. The police might have changed my statement and added that I paid dowry. I do not know about the complaint filed against me.”

AK Mohan Krishna, an advocate who specialises in matrimonial disputes and who is unconnected to this case, said, “This is the first time that the police have registered a FIR against the wife's family for giving dowry. If it is only a demand for dowry, then only the provision of IPC Section 498(A) comes into play. If the wife and her family members have admitted to giving dowry, then they have committed a crime under the Dowry Prohibition (DP) Act. If they have stated that they have given dowry, they are clearly pleading guilty here. Though this provision of punishing those who give dowry is in the Act, in reality it has never been invoked. The same Act is used to punish husbands and their families who receive dowry. Police usually do not take such complaints. But this case seems to be very promising for men who are accused of taking dowry.”

Ulsoor police said, “He (Padmanabhan) was jailed on a case of dowry harassment and he has now filed a complaint against his wife and in-laws. We are investigating the case.”

Don’t make my son villain in Jiah Khan’s story: Aditya Pancholi

Don’t make my son villain in Jiah Khan’s story: Aditya Pancholi

Mumbai: Ever since the news of Nafisa alias Jiah Khan’s suicide has surfaced, days have been very hard on the Pancholi family. Actor Aditya Pancholi says his son Suraj, the late actress’s boyfriend, is being made the “villain” in the story for no reason.
Jiah, 25, was found hanging in her Juhu residence on 4 June. Suraj is being questioned in the matter as the actress was reportedly depressed due to her failing Bollywood career as well as a crumbling personal life.
“If Suraj is to be blamed then please make him the villain,” says protective father Aditya.
Suraj and Aditya Pancholi.
Suraj and Aditya Pancholi.
In a recent blog post, writer Shobhaa De recently commented: “Like father, like son” in reference to Aditya and Suraj. Aditya is clearly unhappy.
“What’s Shobhaa De’s problem with me and my son? What does she mean by saying, ‘Like father, like son?’ Let the truth come out.
If Suraj has done some wrong, let it come out. But don’t condemn him in your column for something he hasn’t done. Everyone has children,” said the hurt father.
Taking a deep breath, Aditya relives the nightmare of a death so close to the family.
He said: “Suraj ki kya galti hai (What’s Suraj’s fault)? They’re probably looking for a villain in this story, and Suraj has been selected as the villain of this story. If you take Raavan out of the ‘Ramayan’, it loses its impact. What is ‘Sholay’ without Gabbar Singh?”
“For the last three days, I’ve done what I could do as a concerned father and the head of my family. Now I’ve the space to see what loss has Jiah’s family suffered. We were there – my son Suraj and I, for the funeral. Not for a second did we think we should stay away just to avoid trouble.
“Jiah and her mother (actress Rabiya Amin) are our friends. We are not going to turn our backs on them just because some questions are being asked by some people who don’t know the truth and are only interested in being judgmental,” he added.
Aditya says his son is going through a rough time.
“Suraj is very hurt and shaken. But what can he do? I know Suraj will be fine. But what about Jiah’s mother and sisters? Would they ever be normal again? Looking at Suraj’s grief, I am reminded of Jiah’s family’s grief,” he said.
Aditya also believes it’s wrong to blame only the broken relationship between Jiah and Suraj as the reason for her suicide.
“There must be other factors. Jiah bottled up all her emotions. Suraj tells me she never raised her voice. He says the maximum she ever raised her voice to say was, ‘Suraj, this is not done’.
“I want to request people to not try to make my son the villain. It’s circumstances that played villain in Jiah’s life. If that one moment when she took that drastic step had been averted, she’d still be alive,” he added.

Jaipur bomb scare: Woman sent e-mail to teach boyfriend lesson

Jaipur bomb scare: Woman sent e-mail to teach boyfriend lesson

HDFC Bank’s 30 year home loan Jaipur, June 6: Peeved over the marriage of her boyfriend, a 25-year-old woman with an intention to land him in trouble sent an e-mail to Chief Minister's office and Jaipur police threatening a bomb blast on June 13. Police said Ritu Sharma had an affair with Amit Jain, who was married to some other girl some time back. Annoyed over the issue, Ritu sent the e-mail from a fake id to Chief Minister's Office, DGP, Jaipur Police commissioner and other police officers yesterday. "The sender unspecifically mentioned the name and postal address of Amit, resident of Pratap Nagar, in the e-mail and said that a letter having information about the plan of bomb blast in Jaipur on June 13 was about to be delivered to him," Additional Police Commissioner Girraj Meena said. "It was also mentioned in the e-mail that there were information related to Army cantonment in the letter following which the Army as well as Central Intelligence authorities were informed and investigation started by police," he said. A police team rushed to the postal address mentioned in the email and held Amit. He expressed ignorance about such e-mail and letter and suspected that her former girlfriend Ritu may be behind this, police said. Meanwhile, the IP addressed of the computer which was used to create and send the e-mail was traced to a cyber cafe in Vaishali Nagar. The cyber cafe owner verified that a woman named Ritu had visited the cafe yesterday. Thereafter, the woman was today picked up for questioning and later placed under arrest under IT Act for her involvement in the matter, police said. Ritu is an MBA degree holder and presently unemployed, DCP (West) Dr Ravi said.

Case against NGO for forcing woman to file false rape case

Case against NGO for forcing woman to file false rape case

A city court has asked the Delhi Police to conduct an investigation into the role of a prominent NGO after a "rescued rape victim" told the court that a worker from the NGO had "tutored" her and told her to falsely depose that she had been raped by her employer, a businessman.

Additional Sessions Judge Nivedita Anil Sharma on Saturday acquitted the businessman — a Punjabi Bagh resident — of the charge of rape.

The court also noted that though the NGO Shakti Vahini had been associated "in over a thousand cases", this case was the first instance in which the NGO had gotten involved to the extent of filing an application for the cancellation of bail of the accused.

The businessman had been granted bail to conduct the last rites of his mother, after spending 72 days in jail. The NGO had filed an application seeking the cancellation of bail.

The court dismissed the application and noted that the NGO had no locus standi to file a petition regarding the bail of an accused.

During arguments, the court found that the woman, who was sent to the Nirmal Chhaya women's home, had written to superintendent of Nirmal Chhaya and that her employer had not raped her.

The prosecution said the woman, who hails from Assam, was a minor and was "rescued" by the NGO and police from the Punjabi Bagh home of the businessman in October 2012.

It said the woman had told police that she was being forcibly kept at the businessman's home for three years with very little pay.

The prosecution had chargesheeted the businessman for rape and under the anti-human trafficking and anti-bonded labour laws.

The chargesheet also said the woman had given a statement that she had been raped numerous times by businessman, who had also "given her some tablets" after raping her.

Husbands cry for rights, form NGO

Husbands cry for rights, form NGO

Demand equal laws, say they are wronged too
Some wives have some or the other problem with their husbands. But as both sexes are equal, legally and otherwise, husbands also have their set of problems with their wives or divorced wives.

Some such men are getting together to demand equality in laws and other instruments in every way vis-a-vis their wives or ex-wives and have formed Men's Rights Association (MRA).

Its President, Atit Rajpara, said, "The Indian court has shielded women from mistreatments from their husbands under the Domestic Violence Act (2005), ensuring every married woman lives with dignity and pride. But it is not always women who face oppression at home and the Act fails to address men who undergo a similar torture."

Acting as rescuer, this "non-funded, non-aided, registered NGO" for men was initiated by Rajpara in the summer of 2011 and currently functions out of his hometown, Pune.
"My wife filed a fictitious litigation against me back in 2010 and booked me with section 498 which defines cruelty by husband or relatives of the husband. I decided that it was the high time that an NGO must come forward to help men like me," he says.

Rajpara points out that according to the National Crime Records Bureau (NCRB) every eight minute, a married man commits suicide out of marital or financial pressure "because the society raises men in a way where they are not allowed to ask for help, neither complain, nor show their weaknesses."

Anurag Goyal, a divorcee earning a salary of Rs 50,000 says he has to give his wife a compensation of 20,000 for maintenance. "I have always seen my wife shopping and going around. My wife is educationally qualified but she doesn't want to do a job. And here I struggle every day to make money," says Goyal.

Rajpara questions the absurdity of the law which takes away men’s right of speech if a sexual harassment case is filed against him "even if it is false". The NGO receives 8-9 calls per day from the men who have been on the receiving end due to the new Domestic Law Act.

Rajpara mentions one such case - Sunil (name changed), a primary teacher based in Delhi who after being married for four years had a secretive affair, which included consensual sex, for six months with a teacher who had joined his school.

The lady teacher married someone else, but when confronted by her husband, denied the affair and termed it as rape. As a consequence Sunil had to spend 218 days in jail and is still fighting for the case on bail.

"All we want is proper trials that should be fairly conducted and not just approve husbands as guilty. Also, a woman must also get the same punishment as a male gets when proven guilty," says Swarop Sarkar, General Secretary, MRA.

RCF police have finally registered an FIR in the case wherein a freelance photographer in Chembur committed suicide.

Prakash Patni (32), who hung himself at his residence on Monday, had allegedly scribbled a "suicide note" in pencil on the wall of his home, implying that his wife, her mother and aunt were responsible for his death. On Sunday, police registered a case against Patni's wife Dimple (28), her mother Jaishree Kundani and aunt Mohini Kundani.

Patni's brother Mohan (34) told Mumbai Mirror that police was reluctant to lodge a complaint citing lack of evidence. "My brother has clearly mentioned these three names. Then too police failed to register a complaint. On Saturday, I and my family were made to sit in the police station for hours. After much reluctance, they registered an FIR on Sunday at midnight, but told us that the accused will not be arrested till the court orders," he said.

"His mother-in-law used to visit their house almost everyday. She stays in Koparkhairne, but her husband runs a garage in Chembur. Often, my brother used to complain of harassment by the in-laws. My parents used to pay his rent and food bills," said Mohan.

"As per the complaint by Patni's father Jagdish, we have registered a case under IPC section 306 (34), abetment to suicide. Patni was also facing financial difficulties. It's not necessary that only domestic discord could lead to suicide. We didn't register a complaint due to lack of evidence," said a RCF police official, requesting anonymity.

"On Monday, Patni's wife Dimple returned home from Koparkhairne around 1 pm. When he failed to open the door, she lifted the curtain at one of the windows to find him hanging by the ceiling fan. Patni was staying on rent at Building No. 18 of Chembur Camp with his wife and son Piyush (7) for the last two years. He worked as a freelance photographer and videographer. On the wall in his house, he wrote, "Because of my wife and her mother Jaishree Kundani and Mohini Kundani, its over."

A few hours before he committed suicide, he had also written various status messages on his Facebook account, saying it was his last day. His mobile records show that at 2.30 am on Monday, he messaged his wife saying, "Dear I am sorry. You have done wrong. Please don't do this to anyone."

Aggrieved men put up a fight

Aggrieved men put up a fight

New Delhi: Tormented? Abused? Humiliated and threatened to be evicted from the house? Yes, you can always seek assistance from the nearest ‘friendly’ women’s organisation.
But what if you are not a woman? Aggrieved men are now finding strength in numbers by banding together to cope with assaults to their dignity and pride by women as well as to fight for equal rights to men.
“The court has shielded women from mistreatments from their husbands under the Domestic Violence Act, ensuring every married woman lives with dignity and pride. But it is not always women who face oppression at home and the Act fails to address men who undergo a similar torture,” says Atit Rajpara, President of Men’s Rights Association (MRA).
Acting as rescuer, this “non-funded, non-aided, registered NGO” for men was initiated by Mr Rajpara in 2011 and currently functions out of his hometown, Pune.
Mr Rajpara points out that according to the National Crime Records Bureau every eight minute, a married man commits suicide out of marital or financial pressure “because the society raises men in a way where they are not allowed to ask for help, neither complain, nor show their weaknesses.”
“All we want is proper trials that should be fairly conducted and not just approve husbands as guilty. Also, a woman must also get the same punishment as a male gets when proven guilty,” says Swarop Sarkar, general secretary of MRA.

Maharashtra: Conviction rate dips in state as many witnesses turn hostile

Maharashtra: Conviction rate dips in state as many witnesses turn hostile

The Maharashtra police are faltering in their effort to combat crime. The conviction rate in the state fell from 25.14% in 2011 to 23.7% last year, underscoring the urgent need for sounder investigations and better coordination between public prosecutors and investigators.

Statistics collated by the directorate of public prosecution show that 3.43 lakh cases (under the Indian Penal Code, central and state laws) were "conducted" or concluded in 2012. Of these, 43,039 ended in convictions. By comparison, the year before, there were convictions in 48,130 cases of the 4.5 lakh that reached closure.

State home minister R R Patil conceded a dip in convictions in Maharashtra over the last few years. "The Democratic Front government in 2011 appointed a committee to study causes of the poor rate and recommend corrective measures. The home department adopted those measures."

Patil said the results of the department's steps will begin showing. "There has already been an improvement in numbers in the first four months of 2013," he said.

The home department claimed there was a marginal rise in conviction rate in 2012, compared to the previous year, but failed to provide figures.

A senior official said the conviction figures are mainly a result of witnesses turning hostile and lack of witnesses. The dearth of witnesses, he said, was the cause for 14.03% acquittals and witnesses turning hostile the reason for 25% exonerations . Director-general of police Sanjeev Dayal pegged the latter figure at 66%.

The worrying conviction rate becomes bothersome when zoomed in on.

State home department data shows convictions were gained in 9% of the Indian Penal Code cases in 2010; the next year, the tally slipped to 8.2%. In 2012, "the compounded conviction rate decreased to 7.8%," a Mantralaya official said.

Other states have better records than Maharashtra . In 2011, the National Crime Records Bureau said, while Maharashtra achieved convictions in 8.2% IPC cases, Uttar Pradesh scored convictions in 59.6% such cases, New Delhi in 58.1% and Haryana in 25.1%.

Taking note of the trend, Dayal had recently emphasised the need for better coordination between prosecutors and investigators. He ordered senior officers of assistant commiss ioner rank to investigate violent crimes so as to build watertight cases which prosecutors can take to their logical end. For serious crimes against women, he said probes must be supervised by deputy commissioners to ensure sound paperwork before filing of chargesheets.

Harassed by female cop friend, man commits suicide

Harassed by female cop friend, man commits suicide

NASHIK: A 25-year-old youth, who was scheduled to get married today, allegedly committed suicide after a woman with whom he had friendship, pressurised him to either tie the knot with her or pay her Rs three lakh, police said on Sunday.

Deepak Savkar Barve, from Bortembhe village, ended his life yesterday by jumping before a speeding train near Shilapur.

A note was found on him which mentioned that woman police constable Manisha Kujure - posted at the Nashik rural police headquarters in Adgaon - with whom he had a friendship, threatened to break his impending marriage and demanded that either he should pay Rs three lakh or marry her, police said.

Based on a complaint by the deceased's father, police have registered an offence against seven persons, including the constable, aged around 24 years, and her family members, for allegedly harassing the youth and abetting his suicide.

Rape accused freed, girl faces perjury

Rape accused freed, girl faces perjury

NEW DELHI: Implicating two youths in heinous crime like gangrape has boomeranged on a 20-year-old girl as a Delhi court not only allowed the accused to walk free but also ordered her prosecution for the offence of perjury.

The court, which said it cannot restore the "lost honour" of the accused, also noted, "It is very regrettable that a trend has set in now a days where the investigating officers dance to the tunes of the girl complaining of rape, completely throwing to winds their duties and responsibilities."

"This is a fit case where the prosecutrix (girl) deserves to be proceeded against for committing the offences punishable under section 193/196 (giving false evidence in a judicial proceeding) of the IPC," additional sessions judge Virender Bhat said.

The court ordered that copy of its judgment be sent to Delhi Police commissioner and others so that efforts can be taken to "sensitize" and "train" police officers to conduct probe in such cases with "an open mind without treating the statement of the girl as gospel truth".

Police had arrested Preetam Yadav and Manoj Kumar Yadav in November 2011 after the girl complained that they had raped her. During the trial, advocate Vikas Padora, appearing for Manoj, said that at the time and date of the alleged incident, the accused, along with his family, was at a hotel in Gurgaon celebrating his daughter's birthday.
